~ ORDINANCE NO. 99- 19 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />APPROVING AN AGREEMENT BETWEEN <br />THE VILLAGE OF MAYFIELD AND <br />THE CITY OF WILLOUGHBY HILLS <br />PROVIDING FOR THE CONSENT OF THE INSTALLATION <br />OF A TRAFFIC CONTROL DEVICE AT THE INTERSECTION <br />OF S.O.M. CENTER ROAD AND WHITE ROAD <br />WHEREAS, the Village of Mayfield, a municipal corporation and political subdivision <br />in and of the State of Ohio, seeks an agreement with the City of Willoughby Hills, a <br />political subdivision in and of the State of Ohio, to provide consent for the installation of <br />a traffic control device located at the intersection of S.O.M. Center Road and White Road; <br />and <br />WHEREAS, in March of 1999, URS Greiner Woodward Clyde compiled a signal <br />traffic warrant study entitled Signal Warrant Analysis SOM/Progressive Insurance; and <br />WHEREAS, as a result of this analysis it was determined that this location satisfies <br />one of the warrants for the installation of a traffic control device in accordance with the <br />Ohio Manual of Uniform Traffic Control Devices; and <br />WHEREAS, the Village of Mayfield will take responsibility for negotiating all <br />consents and approvals from the State of Ohio, Department of Transportation and such <br />other State agencies as are necessary and/or required by law; and <br />WHEREAS, the cost of said construction of the traffic control device, including any <br />related poles needed, will be paid fully and exclusively by the Village of Mayfield; and <br />WHEREAS, the Village of Mayfield also agrees to be fully responsible for the <br />construction, installation and maintenance of said traffic control device; and <br />WHEREAS, this council finds that the installation of said traffic control device is <br />necessary both to the Village of Mayfield and to the City of Willoughby Hills. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor, President of Council and Director of Law are hereby <br />and herein authorized and directed to enter into an agreement with the City of Willoughby <br />Hills, the terms of which are set forth in a an agreement attached hereto as Exhibit A, and <br />when executed shall be substantially in accordance with those terms. <br />~ -. <br />
