SEE REVISED ORDINANCE <br />_ ORDINANCE NO. 99- 20 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />CREATING SECTION 537.21 OF THE <br />CODIFIED ORDINANCES PERTAINING TO THE <br />POSSESSION AND USE OF LASER POINTING DEVICES <br />WHEREAS, there has been substantial evidence as to the danger and annoyance <br />caused by laser pointing devices which are used in an improper or offensive manner; and <br />WHEREAS, it is the purpose of this legislation to control the possession and <br />prohibit the abuse of such devices. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Section 537.21 is hereby and herein created to read as follows: <br />537.21 POSSESSION/USE OF LASER POINTING DEVICES <br />(a) It shall be unlawful for any person to focus, point or shine <br />a laser beam directly or indirectly on another person or animal <br />in such a manner as to harass, annoy, or injure said person or <br />animal. <br />(b) It shall be unlawful for any person under the age of <br />eighteen (18) years to possess a laser pointing device. A <br />person shall not be in violation of this section if his or her <br />possession of a laser pointing device is necessary for his or <br />her employment, trade or occupation and it is necessary for <br />the pointer to be carried on his or her person. <br />(c) Whoever violates this section is guilty of a misdemeanor of <br />the third degree. <br />SECTION 2. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />
