56A DUI• Willful Misconduct• Sneed 333.99 <br />333.10 OPERATION IN VIOLATION OF INIMOBILIZATION ORDER. <br />(a) No person shall operate a motor vehicle or permit the operation of a motor vehicle <br />upon any public or private property used by the public for vehicular travel or parking knowing or <br />having reasonable cause to believe that the motor vehicle has been ordered immobilized pursuant <br />to an immoblization order issued under Ohio R.C. 4503.233. <br />(b) A motor vehicle that is operated by a person during a violation of subsection (a) <br />hereof shall be criminally forfeited in accordance with the procedures contained in Ohio R.C. <br />4503.234, but such forfeiture is subject to Ohio R.C. 4503.235. <br />(ORC 4503.236) <br />333.99 PENALTY. <br />(a) General Classification. <br />(1) General classification. Whoever violates any provision of this Traffic <br />Code, for which violation no penalty is otherwise provided, is guilty of <br />a misdemeanor of the second degree. <br />(b) Drivin~~Under the Influence. Whoever violates Section 333.01(a), in addition to <br />the license suspension or revocation provided in Ohio R.C. 4507.16, and any disqualification <br />imposed under Ohio R.C. 4506.16, shall be punished as provided in paragraph (1), (2), (3) or (4) <br />below. The court, in addition to and independent of any sentence that it unposes upon the offender <br />for a violation of Section 333.01(a), shall order the immobilization of the vehicle and <br />impoundment of the license plates or forfeiture of the vehicle as provided in Ohio R.C. 4511.193: <br />(1) Except as otherwise provided in subsections (b)(2) to (b)(4) hereof, the <br />offender is guilty of a misdemeanor of the first degree and the court shall <br />sentence the offender to a term of imprisonment of three consecutive days <br />and may sentence the offender pursuant to Section 303.99(b) to a longer <br />term of imprisonment. In addition, the court shall impose upon the <br />offender a fine of not less than two hundred dollars ($200.00) and not more <br />than one thousand dollars ($1,000). <br />1999 Replacement <br />
