consistent with other typical antenna arrays currently existing on other Towers on the date hereof, without
<br />any limitation on the increase in the weight or sail area resulting from such expansion or upgrade;
<br />provided, however, that such Sublessor shall be solely responsible for all costs and expenses for any and
<br />all struchrral modifications to the Tower that TowerCo deems reasonably necessary to accommodate such
<br />expansion by such Sublessor as of the date of such expansion without taking into account any future uses
<br />of the Tower. Within ten (10) days following such expansion, Sublessor and TowerCo shall amend the
<br />applicable Site Designation Supplement to reflect such expansion.
<br />(c) Subject to the availability of Available Space on the applicable Tower at the time
<br />of the proposed expansion, each Sublessor shall have the fiuther right to expand Reserved Space on a
<br />Tower by increasing the number of panels on any such Sublessor's Tower beyond the first twelve (12),
<br />provided that such Sublessor shall pay TowerCo $100.00 per month per panel so added, which amount
<br />shall be subject to increase by the Annual Adjustment throughout the Term of this Agreement beginning
<br />on the first anniversary of the date of this Agreement and on each subsequent anniversary of the date of
<br />this Agreement.
<br />(d) Subject to the availability of Available Space on the applicable Tower at the time
<br />of the proposed expansion, each Sublessor shall have the fiuthe;right to expand Reserved Space on a
<br />Tower by increasing the number of microwave transmitters/receivers on any such Sublessof s Tower,
<br />provided that such Sublessor shall pay TowerCo $385.00 per month per such Microwave Space so added,
<br />which amount shall be subject to increase by the Annual Adjustment throughout the Term of this
<br />Agreement beginning on the first anniversary of the date of this Agreement and on each subsequent
<br />anniversary of the date of this Agreement.
<br />6. PERMITTED USE.
<br />(a) TowerCo shall use, and shall permit the use of, the Subleased Property of each Site
<br />only for the Permitted Use.
<br />(b) Each Sublessor shall use, and shall permit the use of, the Reserved Space of each
<br />Sublessors' Sites only for the Permitted Use, by such Sublessor or its pemutted assigns or successors, and
<br />such Sublessors shall not sublease or permit use of such space to any party other than an Affiliate of
<br />AirTouch or such Sublessor.
<br />(c) TowerCo shall not use, or pemrit to be used, the Subleased Property of any Site, or
<br />any portion thereof; by TowerCo, any Person (other than AirTouch or any other Sublessor) or the public
<br />in such manner as might reasonably tend to impair the applicable Sublessor's title to or interest in such
<br />Site, or any portion thereof, or in such manner as might reasonably make possible a Claim or Claims of
<br />adverse usage or adverse possession by the public, as such, or any Person (other than AirTouch or any
<br />other Sublessor), or of implied dedication of such Subleased Properly, or any portion thereof. Nothing
<br />contained in this Agreement and no action or inaction by AirTouch or any other Sublessor shall be
<br />deemed or construed to mean that AirTouch or any other Sublessor has granted to TowerCo any right,
<br />power or permission to do any act or make any agreement that may create, or give rise to or be the
<br />foundation for any such right, title, interest, lien, charge or other encumbrance upon the estate of
<br />AirTouch or any other Sublessor in any Site.
<br />(d) Each Sublessor shall not use, or pemut to be used, the Reserved Space of any Site,
<br />or any portion thereof, by such Sublessor, any Person (other than Tower~o and Space Subtenants) or the
<br />public in such manner as might reasonably tend to impair TowerCo's title to or interest in such Site, or
<br />any portion thereof, or in such manner as might reasonably make possible a Claim or Claims of adverse
<br />usage or adverse possession by the public, as such, or any Person (other than TowerCo and Space
<br />Subtenants), or of implied dedication of such Reserved Space, or any portion thereof. Nothing contained
