ORDINANCE N0. 99- 37 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE GRANTING A SPECIAL USE PERMIT FOR MEDICAL USES AT THE GEORGIAN CENTER BUILDING 730 S.O.M. CENTER ROAD WHEREAS, the owners of Georgian Center Building located at 730 S.O.M. Center Road have applied for a Special Use Permit to allow 20,116 square feet of the building to be used for medical use; and WHEREAS, Council has determined that such Special Use Permit will be granted with the condition that the parking will be as per the submitted plan and further on the condition. that banked parking will be installed if Council deems necessary at any time in the future upon thirty days notice. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That a Special Use Permit is hereby and herein granted to the Georgian Center Building located at 730 S.O.M. Center Road, permitting 20,116 square feet of the building to be used for medical use with appropriate parking as per the submitted plan, and upon the condition that the banked parking being shown on the plan will be installed upon thirty days notice from the Village Council. SECTION 2. This Special Use Permit will expire at the end of three (3) years from the date of the adoption of this Ordinance, and must be applied for renewal at that time. SECTION 4. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 5. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law. ,, , V'UILLIAM MARQUARDT Council President /,
