ORDINANCE N0. 99- 37 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />GRANTING A SPECIAL USE PERMIT <br />FOR MEDICAL USES AT THE GEORGIAN CENTER BUILDING <br />730 S.O.M. CENTER ROAD <br />WHEREAS, the owners of Georgian Center Building located at 730 S.O.M. Center <br />Road have applied for a Special Use Permit to allow 20,116 square feet of the building to <br />be used for medical use; and <br />WHEREAS, Council has determined that such Special Use Permit will be granted <br />with the condition that the parking will be as per the submitted plan and further on the <br />condition. that banked parking will be installed if Council deems necessary at any time in <br />the future upon thirty days notice. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That a Special Use Permit is hereby and herein granted to the <br />Georgian Center Building located at 730 S.O.M. Center Road, permitting 20,116 square <br />feet of the building to be used for medical use with appropriate parking as per the <br />submitted plan, and upon the condition that the banked parking being shown on the plan <br />will be installed upon thirty days notice from the Village Council. <br />SECTION 2. This Special Use Permit will expire at the end of three (3) years from <br />the date of the adoption of this Ordinance, and must be applied for renewal at that time. <br />SECTION 4. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 5. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law. ,, , <br />V'UILLIAM MARQUARDT <br />Council President /, <br />
