ORDINANCE NO. 99- 45 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING A CHANGE ORDER WITH CAPUTO-MARTINI CONSTRUCTION COMPANY IN AN AMOUNT NOT TO EXCEED $44,500.00 WHEREAS, the contractor for the municipal pool and bathhouse has submitted its final change order attached hereto and incorporated herein as Exhibit A; and WHEREAS, it is the desire of Council to approve this final change order with Caputo-Martini Construction Company in the amount of $44,500.00. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the final change order with Caputo-Martini Construction Company,attached hereto and incorporated herein as Exhibit A, is hereby and herein authorized in an amount not to exceed $44,500.00 SECTION 2. That the Mayor and Director of Finance are authorized to enter into ~, any agreement for this final change order necessary, and to make payment as called for ~' therein out of the appropriate accounts of the Village. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 4. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law. z ` ~~ ILLIAM MA UARDT Council Presi ent
