..1 . <br />ORDINANCE NO. 98- 02 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING A LEASE AGREEMENT WITH WHITING <br />TURNER CONTRACTING COMPANY FOR THE <br />PARKVIEW GOLF COURSE CLUB HOUSE LOCATED <br />AT 320 SOM CENTER ROAD <br />WHEREAS, the Village is now in ownership of the Parkview Golf Course and the <br />buildings thereon, one of which is the club house known as 320 SOM Center Road; and <br />WHEREAS, the contracting company, engineers and contractors wish to use the <br />club house for purposes of their operations; and <br />WHEREAS, the Village is willing to allow same for the cost of $850.00 per month <br />rental fee. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and directed to <br />- . enter into a lease agreement with the Whiting Turner Contracting Company for the club <br />f house at 320 SOM Center Road for an amount of $850.00 per month commencing <br />February 1, 1998, on a month to month basis with 60 days notice for termination from <br />either side. <br />SECTION 2.. The terms of the lease will be prepared by the Law Director <br />consistent with the terms set forth herein. <br />SECTION 3. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in compliance with all <br />statutory requirements including the requirements of Section 121.22 of the Ohio Revised <br />Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio, and for the further reasons that time is of the essence both to act to protect <br />and preserve the existing eco-system and with respect to offered acquisition funding. <br />It shall, therefore, take effect immediately upon the passage by the affirmative vote of not <br />less than five (5) members elected to Council and approval by the Mayor or otherwise <br />at the earliest time allowed by law. <br />
