ORDINANCE NO. 98- 02 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING A LEASE AGREEMENT WITH WHITING TURNER CONTRACTING COMPANY FOR THE PARKVIEW GOLF COURSE CLUB HOUSE LOCATED AT 320 SOM CENTER ROAD WHEREAS, the Village is now in ownership of the Parkview Golf Course and the buildings thereon, one of which is the club house known as 320 SOM Center Road; and WHEREAS, the contracting company, engineers and contractors wish to use the club house for purposes of their operations; and WHEREAS, the Village is willing to allow same for the cost of $850.00 per month rental fee. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the Mayor is hereby and herein authorized and directed to - . enter into a lease agreement with the Whiting Turner Contracting Company for the club f house at 320 SOM Center Road for an amount of $850.00 per month commencing February 1, 1998, on a month to month basis with 60 days notice for termination from either side. SECTION 2.. The terms of the lease will be prepared by the Law Director consistent with the terms set forth herein. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 4. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio, and for the further reasons that time is of the essence both to act to protect and preserve the existing eco-system and with respect to offered acquisition funding. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
