ORDINANCE NO. 98- ~~ <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />APPROVING THE DEDICATION PLAT OF CHAGRIN <br />COMMONS BOULEVARD <br />WHEREAS, the Planning Commission, on February 2, 1998, approved the location, <br />dimensions and dedication of Chagrin Commons Boulevard, as same is indicated in <br />Exhibit "A", attached hereto and incorporated herein by reference; and <br />WHEREAS, the approval of this dedication plat will enhance the development of <br />the Northwest Quadrant of the Village of Mayfield; and <br />WHEREAS, this dedication plat is considered to be a preliminary approval, for <br />record purposes only, and will not be finalized and accepted for dedication purposes <br />until such roadway has been constructed pursuant to the codes and specifications of the <br />Village of Mayfield. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. That the dedication plat of Chagrin Commons Boulevard, attached <br />hereto and incorporated herein as Exhibit "A", is hereby and herein preliminarily approved <br />for record purposes only, final acceptance for dedication purposes will be completed <br />upon construction of the road pursuant to the codes and specifications of the Village of <br />Mayfield. <br />SECTION 2. The Clerk of Council is directed to record such dedication plat <br />approval for Chagrin Commons Boulevard with the appropriate public agencies, after <br />signatures are attached hereto, and pursuant to instructions of the Village Engineer. <br />SECTION 3. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in compliance with all <br />statutory requirements including the requirements of Section 121.22 of the Ohio Revised <br />Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law. <br />i <br />
