ORDINANCE NO. 98- ~~ INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE APPROVING THE DEDICATION PLAT OF CHAGRIN COMMONS BOULEVARD WHEREAS, the Planning Commission, on February 2, 1998, approved the location, dimensions and dedication of Chagrin Commons Boulevard, as same is indicated in Exhibit "A", attached hereto and incorporated herein by reference; and WHEREAS, the approval of this dedication plat will enhance the development of the Northwest Quadrant of the Village of Mayfield; and WHEREAS, this dedication plat is considered to be a preliminary approval, for record purposes only, and will not be finalized and accepted for dedication purposes until such roadway has been constructed pursuant to the codes and specifications of the Village of Mayfield. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the dedication plat of Chagrin Commons Boulevard, attached hereto and incorporated herein as Exhibit "A", is hereby and herein preliminarily approved for record purposes only, final acceptance for dedication purposes will be completed upon construction of the road pursuant to the codes and specifications of the Village of Mayfield. SECTION 2. The Clerk of Council is directed to record such dedication plat approval for Chagrin Commons Boulevard with the appropriate public agencies, after signatures are attached hereto, and pursuant to instructions of the Village Engineer. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 4. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law. i
