ORDINANCE NO. 98- 09 ~- _ - INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING AN AGREEMENT FOR THE SALE OF APPROXIMATELY 52 ACRES TO PROGRESSIVE CASUALTY INSURANCE COMPANY WHEREAS, the Village has previously entered into a development agreement for the Northwest Quadrant of the Village of Mayfield in order to assure the development of this area to be conducive with the health, safety and welfare of the residents in this community; and WHEREAS, toward that end, the Village has previously acquired the Parkview Golf Course for certain public purposes; and WHEREAS, the Village Council, Planning Commission and various public committees and boards have determined that the golf course is no longer seen as serving a public use; and WHEREAS, it has been determined by the Village Council and the recommendation __. of the Planning Commission that a certain portion of the golf course property be sold to Progressive at a significantly increased rate of return, and in exchange for receiving other properties which will be conducive for protecting the environmental beauty of the area and enhancing the development of recreational fa ilities and parks. NOW, THEREFORE, BE IT ORDAI ED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the Mayor and Director of Finance. are hereby and herein authorized and directed to enter into an agreement with Progressive Casualty Insurance Company in a form substantially the same as that set forth in Exhibit "A" attached hereto and incorporated herein by reference, as and for the sale of approximately 52 acres from the Village to Progressive, as more fully described in Exhibit "A". SECTION 2. That Council approves the acceptance of the purchase price as referred to in Section 2 of the purchase agreement contained in Exhibit "A". - SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
