ORDINANCE NO. 98- 09 <br />~- _ - INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AN AGREEMENT FOR THE SALE OF <br />APPROXIMATELY 52 ACRES TO PROGRESSIVE CASUALTY <br />INSURANCE COMPANY <br />WHEREAS, the Village has previously entered into a development agreement for <br />the Northwest Quadrant of the Village of Mayfield in order to assure the development of <br />this area to be conducive with the health, safety and welfare of the residents in this <br />community; and <br />WHEREAS, toward that end, the Village has previously acquired the Parkview Golf <br />Course for certain public purposes; and <br />WHEREAS, the Village Council, Planning Commission and various public <br />committees and boards have determined that the golf course is no longer seen as serving <br />a public use; and <br />WHEREAS, it has been determined by the Village Council and the recommendation <br />__. of the Planning Commission that a certain portion of the golf course property be sold to <br />Progressive at a significantly increased rate of return, and in exchange for receiving other <br />properties which will be conducive for protecting the environmental beauty of the area and <br />enhancing the development of recreational fa ilities and parks. <br />NOW, THEREFORE, BE IT ORDAI ED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor and Director of Finance. are hereby and herein <br />authorized and directed to enter into an agreement with Progressive Casualty Insurance <br />Company in a form substantially the same as that set forth in Exhibit "A" attached hereto <br />and incorporated herein by reference, as and for the sale of approximately 52 acres from <br />the Village to Progressive, as more fully described in Exhibit "A". <br />SECTION 2. That Council approves the acceptance of the purchase price as <br />referred to in Section 2 of the purchase agreement contained in Exhibit "A". - <br />SECTION 3. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />
