ORDINANCE NO. 98- 19 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />DECLARING THE NECESSITY AND INTENTION TO <br />APPROPRIATE FOR STREET PURPOSES A <br />A FEE SIMPLE INTEREST IN AND TO THE PREMISES <br />KNOWN AS PERMANENT PARCEL NOS. 831-5-27, 831-5-28, 831-5-29, <br />831-5-30, 831-5-31, 831-5-44, 831-5-45, 831-5-46, 831-5-47, 831-5-48 <br />WHEREAS, in promotion of the public interest of the residents of the Village of <br />Mayfield, it is necessary for the Village to appropriate for street purposes a fee simple <br />interest in and to the premises known as Permanent Parcel Nos. 831-5-27, 831-5-28, 831- <br />5-29, 831-5-30, 831-5-31, 831-5-44, 831-5-45, 831-5-46, 831-5-47, 831-5-48; and <br />WHEREAS, in accordance with Ohio Revised Code Section 719.05, only one <br />reading of this Ordinance shall be required. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That this Council deems it necessary and declares its intention to <br />appropriate for street purposes a fee simple interest inthepremises known as Permanent <br />Parcel Nos. 831-5-27, 831-5-28, 831-5-29, 831-5-30, 831-5-31, 831-5-44, 831-5-45, 831- <br />5-46, 831-5-47, 831-5-48, and is further described in the attached Exhibits A, B, and C, <br />incorporated herein by reference as if fully rewritten. <br />SECTION 2. That the Mayor be, and hereby and herein is, authorized and directed <br />to cause written notice of the passage of this Ordinance to be given to the owners or <br />persons in possession or having an interest of record in the premises; and that said notice <br />shall be served and returned according to law. <br />SECTION 3. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio and for the further reasons that time is of the essence both to act, to protect, <br />and preserve the existing ecosystem and with respect to offered acquisition funding. It <br />shall, therefore, take effect immediately upon the passage by the affirmative vote of not <br />less than five (5) members elected to Council and approval by the Mayor or otherwise at <br />the earliest time allowed by law. <br />
