--- ORDINANCE NO. 98- 21 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING A WATER POLLUTION CONTROL LOAD FUND <br />FOR CONSTRUCTION, MAINTENANCE AND OPERATION OF <br />A STATE WASTEWATER PROJECT BETWEEN <br />MAYFIELD VILLAGE, OHIO, THE OHIO ENVIRONMENTAL <br />PROTECTION AGENCY, AND THE OHIO WATER DEVELOPMENT AUTHORITY <br />WHEREAS, Mayfield Village is desirous of proceeding forward to construct, <br />maintain, and operate certain water pollution control facilities improvements; and <br />WHEREAS, Mayfield Village desires to cooperate with the Ohio Environmental <br />Protection Agency (hereinafter referred to as the "OEPA") and Ohio Water Development <br />Authority (hereinafter referred to as the "OWDA") in the construction, maintenance, and <br />operation of such facilities through the Water Pollution Control Load Fund; and <br />WHEREAS, the OEPA and OWDA has stated its desire to cooperate in the <br />construction, maintenance, and operation of such facilities under the provisions, terms, <br />and conditions set forth in the Water Pollution Control Load Fund Agreerrment. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Mayfield Village hereby approves the construction, maintenance, <br />and operation of the aforesaid water pollution control facilities further described in Exhibit <br />A, attached hereto and incorporated herein, in cooperation. with the OEPA and OWDA <br />under the provisions, terms and conditions set forth in the "The Water Pollution Control <br />Load Fund Agreement" and hereby authorizes the Mayor the Director of Finance of <br />Mayfield Village to execute such agreements .with the OEPA and the OWDA substantially <br />in the form set forth. <br />SECTION 2. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance- have been taken at open meetings of <br />this Council; and that deliberations of this Council and of.its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to'be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio and for the reason that the water pollution control facilities improvement <br />construction will protect the residents' health, safety; and welfare..lt shall, therefore, take <br />effect immediately upon the passage by the affirmative vote .of not less than five (5) <br />_ members elected to Council and approval~by the Mayor or otherwise at the earliest time <br />- allowed by law.
