--- ORDINANCE NO. 98- 21 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING A WATER POLLUTION CONTROL LOAD FUND FOR CONSTRUCTION, MAINTENANCE AND OPERATION OF A STATE WASTEWATER PROJECT BETWEEN MAYFIELD VILLAGE, OHIO, THE OHIO ENVIRONMENTAL PROTECTION AGENCY, AND THE OHIO WATER DEVELOPMENT AUTHORITY WHEREAS, Mayfield Village is desirous of proceeding forward to construct, maintain, and operate certain water pollution control facilities improvements; and WHEREAS, Mayfield Village desires to cooperate with the Ohio Environmental Protection Agency (hereinafter referred to as the "OEPA") and Ohio Water Development Authority (hereinafter referred to as the "OWDA") in the construction, maintenance, and operation of such facilities through the Water Pollution Control Load Fund; and WHEREAS, the OEPA and OWDA has stated its desire to cooperate in the construction, maintenance, and operation of such facilities under the provisions, terms, and conditions set forth in the Water Pollution Control Load Fund Agreerrment. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That Mayfield Village hereby approves the construction, maintenance, and operation of the aforesaid water pollution control facilities further described in Exhibit A, attached hereto and incorporated herein, in cooperation. with the OEPA and OWDA under the provisions, terms and conditions set forth in the "The Water Pollution Control Load Fund Agreement" and hereby authorizes the Mayor the Director of Finance of Mayfield Village to execute such agreements .with the OEPA and the OWDA substantially in the form set forth. SECTION 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance- have been taken at open meetings of this Council; and that deliberations of this Council and of.its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 3. This Ordinance is hereby declared to'be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio and for the reason that the water pollution control facilities improvement construction will protect the residents' health, safety; and welfare..lt shall, therefore, take effect immediately upon the passage by the affirmative vote .of not less than five (5) _ members elected to Council and approval~by the Mayor or otherwise at the earliest time - allowed by law.
