2G <br />CHAPTER 709 <br />Telecommunication Right of Way Permits <br />709.01 Permit required. 709.99 Penalty. <br />709.02 Form of pernut. <br />709.03 Amendment of permit after <br />grant. <br />CROSS REFERENCES <br />Power to maintain streets -see Ohio R.C. 717.01, 723.01 <br />Street obstructions -see TRAF. 311.01 <br />709.01 PERMIT REQUIRED. <br />All persons, firms, partnerships, corporations, limited liability companies, trusts, joint <br />stock companies, unincorporated associations, governmental entities, banking institutions, and <br />any other organization, wishing to construct, operate, maintain, reconstruct, and/or rebuild a <br />telecommunications network used to provide telecommunications services to residents, <br />businesses or other premises within Mayfield Village or through Mayfield Village to service <br />other municipalities shall be required to obtain a telecommunications right of way permit from <br />the Building Commissioner in the form and under the requirements provided for in Section <br />709.02. Passed 11-10-97.) <br />709.02 FORM OF PERMIT. <br />The form of the telecommunications right of way permit required under this chapter <br />shall be in the form as set forth in Exhibit "A", attached to original Ordinance 97-45, and <br />expressly made a part hereof by reference. <br />(Ord. 97-45. Passed 11-10-97.) <br />709.03 AMENDMENT OF PERMIT AFTER GRANT. <br />Any telecommunications right of way permit granted under this chapter may be <br />amended only in accordance with the provisions contained in the permit as provided for in <br />Section 709.02 and only upon approval of such amendment by Council. <br />(Ord. 97-45. Passed 11-10-97.) <br />709.99 PENALTY. <br />Any person, firm, partnership, corporation, limited liability company, joint stock <br />company, unincorporated association, governmental entity, banking institution, or any other <br />person or organization who violates any provision of this chapter or any provision of a <br />telecommunications right of way permit granted under this chapter shall be deemed guilty of a <br />misdemeanor of the first degree. <br />(Ord. 97-45.
