(h) "Person" means one or more individuals, corporations, partnerships,
<br />associations, labor organizations, legal representatives, mutual companies, joint stock
<br />companies, trusts, unincorporated organizations, trustees, trustees in bankruptcy, receivers or
<br />fiduciaries.
<br />(i) "Purchase" means to obtain a dwelling through a sale.
<br />(j) "Real estate agent" means a real estate broker or salesman, or a limited real
<br />estate broker or salesman, as defined in Ohio R.C. 4735.01.
<br />(k) "Rent" or "rental" means to lease, sublease, assign or otherwise grant or obtain
<br />the right to occupy a dwelling not owned by the occupant in return for consideration, or a
<br />contract or option to do any of the foregoing.
<br />(1) "Sale" or "sell" means to convey, exchange, transfer or assign legal or
<br />equitable title to, or beneficial interest in, a dwelling in return for consideration, or a contract
<br />or option to do any of the foregoing.
<br />(m) "Solicit" or "solicitation" means any conduct by a real estate agent, or an
<br />employee or agent thereof, intended to induce the owner of a dwelling within the Village to
<br />sell, rent, or list the same, for sale or rental.
<br />(n) "Unlawful discriminatory practice" means any act prohibited by Section 743.04.
<br />(o) "Handicap" means, with respect to a person:
<br />(1) A physical or mental impairment which substantially limits one or more
<br />of such person's major life activities;
<br />(2) A record of having such an impairment; or
<br />(3) Being regarded as having such an impairment, but such term does not
<br />include current, illegal use of or addiction to a controlled substance as
<br />defined in 21 U.S.C. Section 802. (Ord. 98-12. Passed 2-16-98.)
<br />743.03 EXEMPTIONS.
<br />The provisions of this chapter shall not:
<br />(a) Prohibit a religious organization, association, or society, or any nonprofit
<br />institution or organization operated, supervised or controlled by or in
<br />conjunction with a religious organization, association, or society, from limiting
<br />the sale, rental or occupancy of dwellings which it owns or operates for other
<br />than a commercial purpose to persons of the same religion, or from giving
<br />preference to such persons, unless membership in such religion is restricted on
<br />account of race, color, or national origin. Nor shall anything in this chapter
<br />prohibit a private club not in fact open to the public, which as an incident to its
<br />primazy purpose or purposes provides lodgings which it owns or operates for
<br />other than a commercial purpose, from limiting the rental or occupancy of such
<br />lodgings to its members or from giving preference to its members, provided
<br />such club does not discriminate in its membership policies on the basis of race,
<br />color, religion, sex, ancestry, handicap, familial status, or national origin.
