roadway so closely as to constitute an immediate hazard during the time the driver is moving <br />across or within the intersection or junction of roadways. Whenever a driver is involved in a <br />collision with a vehicle in the intersection or junction of roadways, after driving past a yield <br />sign without stopping, the collision shall be prima-facie evidence of the driver's failure to yield <br />the right of way. <br />(ORC 4511.43(B)) <br />331.19 OPERATION OF VEHICLE AT STOP SIGNS. <br />Except when directed to proceed by a law enforcement officer, every driver of a vehicle <br />approaching a stop sign shall stop at a clearly marked stop line, but if none before entering the <br />crosswalk on the near side of the intersection, or, if none, then at the point nearest the <br />intersecting roadway where the driver has a view of approaching traffic on the intersecting <br />roadway before entering it. After having stopped, the driver shall yield the right of way to any <br />vehicle in the intersection or approaching on another roadway so closely as to constitute an <br />immediate hazard during the time the driver is moving across or within the intersection or <br />junction of roadways. <br />(ORC 4511.43(A)) <br />331.20 EMERGENCY OR PUBLIC SAFETY VEHICLES AT STOP <br />SIGNALS OR SIGNS. <br />The driver of any emergency vehicle or public safety vehicle, when responding to an <br />emergency call, upon approaching a red or stop signal or any stop sign shall slow down as <br />necessary for safety to traffic, but may proceed cautiously past such red or stop sign or signal <br />with due regard for the safety of all persons using the street or highway. (ORC 4511.03) <br />331.21 RIGHT OF WAY OF PUBLIC SAFETY OR CORONER'S VEHICLE. <br />(a) Upon the approach of a public safety vehicle or coroner's vehicle, equipped <br />with at least one flashing, rotating or oscillating light visible under normal atmospheric <br />conditions from a distance of 500 feet to the front of the vehicle and the driver is giving an <br />audible signal by siren, exhaust whistle or bell, no driver of any other vehicle shall fail to yield <br />the right-of--way, immediately drive to a position pazallel to and as close as possible to, the <br />right edge or curb of the street cleaz of any intersection, and stop and remain in that position <br />until the public safety vehicle or coroner's vehicle has passed, except when otherwise directed <br />by a police officer. <br />(b) This section does not relieve the driver of a public safety vehicle or coroner's <br />vehicle from the duty to drive with due regazd for the safety of all persons and property upon <br />the street. <br />(c) This section applies to a coroner's vehicle only when the vehicle is operated in <br />accordance with Ohio R.C. 4513.171. As used in this section, "coroner's vehicle" means a <br />vehicle used by a coroner, deputy coroner or coroner's investigator that is equipped with a <br />flashing, oscillating or rotating red or blue light and a siren, exhaust whistle, or bell capable of <br />giving an audible signal. (ORC 4511.45) <br />331.22 DRIVING ONTO ROADWAY FROM PLACE OTHER THAN <br />ROADWAY: DUTY TO YIELD. <br />Subject to compliance with any traffic control device, the operator of a vehicle about to <br />enter or cross a highway from an alley or from any place other than another roadway shall <br />yield the right of way to all traffic approaching on the roadway to be entered or crossed. <br />(ORC 4511.44) <br />1998 Replacement <br />
