(11) Pile drivers and hammers. The operation between 7:00 p.m. and 7:00 <br />a.m. of any pile driver, steam shovel, pneumatic hammer, derrick, steam <br />or electric hoist or other appliance the use of which is attended by loud <br />or unusual noise. <br />(12) Fans. The operation of any blower, exhaust, air conditioning unit or <br />other type of fan which permits noise to emanate therefrom sufficient to <br />disturb the quiet or repose of persons residing in the surrounding area. <br />(13) Noisy animals. No person in the Municipality, being the owner, keeper <br />or harborer of a dog, horse, mule, cow, sheep, goat, swine, cat, <br />chicken, goose or other fowl or animal, shall permit the same to bark, <br />yelp, howl, crow or make any noise in such a manner or to such an <br />extent as to disturb the peace and quiet of any person in the <br />Municipality. <br />(c) No person, while voluntarily intoxicated shall do either of the following: <br />(1) In a public place or m the presence of two or more persons, engage in <br />conduct likely to be offensive or to cause inconvenience, annoyance or <br />alarm to persons of ordinary sensibilities, which conduct the offender, <br />if the offender were not intoxicated, should know is likely to have that <br />effect on others; <br />(2) Engage in conduct or create a condition that presents a risk of physical <br />harm to the offender or another, or to the property of another. <br />(d) Violation of any statute or ordinance of which an element is operating a motor <br />vehicle, locomotive, watercraft, aircraft or other vehicle while under the influence of alcohol <br />or any drug of abuse, is not a violation of subsection (c) hereof. <br />(e) When to an ordinary observer a person appears to be intoxicated, it is probable <br />cause to believe that person is voluntarily intoxicated for purposes of subsection (c) hereof. <br />(ORC 2917.11; Ord. 78-56. Passed 11-20-78.) <br />(f) Whoever violates this section is guilty of disorderly conduct. Except as <br />otherwise provided in this subsection, disorderly conduct is a misdemeanor of the fourth <br />degree. If the offender persists in disorderly conduct after reasonable warning or request to <br />desist or if the offense is committed in the vicimty of a school, disorderly conduct is a <br />misdemeanor of the third degree. <br />(g) As used in this section, "committed in the vicinity of a school" has the same <br />meaning as in Ohio R.C. 2925.01. <br />(ORC 2917.11; Ord. 96-26. Passed 8-5-96.) <br />509.04 DISTURBING A LAWFUL MEETING. <br />(a) No person, with purpose to prevent or disrupt a lawful meeting, procession or <br />gathering, shall do either of the following: <br />(1) Do any act which obstructs or interferes with the due conduct of such <br />meeting, procession or gathering; <br />(2) Make any utterance, gesture or display which outrages the sensibilities <br />of the group. <br />1998 Replacement <br />
