(North Chagrin Commons -Interior Access Road file) ORDINANCE NO. 98- 23 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING AN AGREEMENT WITH PERK COMPANY, INC. AS AND FOR IMPROVEMENTS RELATED TO THE NORTH CHAGRIN COMMONS DEVELOPMENT WHEREAS, the Village through URS Greiner has prepared specs and advertised for bids, pursuant to law, as and for certain improvements associated with the North Chagrin Commons development; and WHEREAS, the seven bids were analyzed by URS Greiner, and the lowest and best bid was that of Perk Company, Inc. to whom URS Greiner recommends the awarding of said contract. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the Mayor is hereby and herein authorized and directed to enter into an agreement with Perk Company, Inc., as and for improvements to the North Chagrin _ _ Commons development as indicated in the bid documents, attached hereto and ~_~~ '~ ~ incorporated herein as Exhibit A, upon the condition that the Village receive a notarized r letter from the bidder acknowledging the scope of the work, including the rock excavation required to install the sanitary sewer for the bid item 603,12 inch conduit, as per plan. SECTION 2. Based upon the conditions being met in Section 1 hereof, and a contract entered into between the parties satisfactory to the Department of Law, the Director of Finance is authorized to make payment to Perk Company, Inc. for an amount not to exceed Two Million Eighty-Nine Thousand Four Hundred and Fifty-One Dollars and Sixty Cents ($2,089,451.60). SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 4. This Ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
