(North Chagrin Commons -Interior Access Road file) <br />ORDINANCE NO. 98- 23 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AN AGREEMENT WITH PERK COMPANY, INC. <br />AS AND FOR IMPROVEMENTS RELATED TO THE <br />NORTH CHAGRIN COMMONS DEVELOPMENT <br />WHEREAS, the Village through URS Greiner has prepared specs and advertised <br />for bids, pursuant to law, as and for certain improvements associated with the North <br />Chagrin Commons development; and <br />WHEREAS, the seven bids were analyzed by URS Greiner, and the lowest and best <br />bid was that of Perk Company, Inc. to whom URS Greiner recommends the awarding of <br />said contract. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and directed to enter <br />into an agreement with Perk Company, Inc., as and for improvements to the North Chagrin <br />_ _ Commons development as indicated in the bid documents, attached hereto and <br />~_~~ '~ ~ incorporated herein as Exhibit A, upon the condition that the Village receive a notarized <br />r letter from the bidder acknowledging the scope of the work, including the rock excavation <br />required to install the sanitary sewer for the bid item 603,12 inch conduit, as per plan. <br />SECTION 2. Based upon the conditions being met in Section 1 hereof, and a <br />contract entered into between the parties satisfactory to the Department of Law, the <br />Director of Finance is authorized to make payment to Perk Company, Inc. for an amount <br />not to exceed Two Million Eighty-Nine Thousand Four Hundred and Fifty-One Dollars and <br />Sixty Cents ($2,089,451.60). <br />SECTION 3. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law. <br />
