-- ~?,;~~NANCE NO. 98- 27 <br />livTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />EXTENDING THE CONTRACT WITH <br />BFI WASTE SYSTEMS OF OHIO, INC. UNTIL APRIL 1, 1999 <br />WHEREAS, the Village has an agreement with BFI Waste Systems of Ohio, Inc. <br />(hereinafter "BFI.") as and for rubbish collection, recycling and disposal which expires on <br />August 1, 1998; and <br />WHEREAS, the Village is investigating alternative contractual arrangements forthe <br />providing of such services; and <br />WHEREAS, additional time is required for such investigation and BFI has agreed <br />to an extension of the existing contract, upon the same terms and conditions, until April 1, <br />1999. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and directed to enter <br />int~.,an extension agreement with BFI Waste Systems of Ohio, Inc. for waste collection, <br />,`° - '°xe~`i;YCiii.g and disposal for the time period between August 1, 1998 and April 1, 1999, upon <br />the same terms and conditions as in the existing contract adopted by Ordinance No. 93-31. <br />SECTION 2. That the Director of Finance is authorized to make payment upon the <br />same terms as the existing agreement with BFI. <br />SECTION 3. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this <br />Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio and for the further reasons that time is of the essence both to act, to protect, <br />and preserve the existing ecosystem and with respect to offered acquisition funding. It <br />shall, therefore, take effect immediately upon the passage by the affirmative vote of not <br />less than five (5) members elected to Council and approval by the Mayor or otherwise at <br />the earliest time allowed by law. <br />~i~IIARK FIXER <br />,~~~___1 Council President <br />
