_ ORDINANCE NO. 98- 28 <br />PAGE FOUR <br />1325.05 CONFLICT OF LAWS. <br />In the event of a conflict between any of the provisions of the Ohio Plumbing <br />Code, as adopted in Section 1325:01, and a provision of any other standard <br />technical code adopted by the Village, or any local ordinance, resolution, <br />rule or regulation, the stricter standard shall control. <br />1325.99 PENALTY; EQUITABLE REMEDIES. <br />(a) Whoever violates or fails to comply with any of the provisions of the <br />Ohio Plumbing Code., as adopted in Section 1325.01, is guilty of a <br />misdemeanor of the third degree and shall be fined not more than five <br />hundred dollars ($500.00) or imprisoned not more than sixty (60) <br />days or both, for each offense. Unless otherwise provided, a <br />separate offense shall,, be deemed committed each day during or on <br />which a violation or noncompliance occurs or continues. <br />(b) The application of the. penalty provided in subsection (a) hereof shall <br />not be deemed to prevent the. enforced removal of prohibited <br />conditions, or the application of any other equitable remedy. <br />SECTION 3. That Section 1329:.03 of the Building Code of Mayfield Village is <br />repealed in its entirety, and is amended to-,read as follows: <br />1329.03 AMENDMENTS. <br />The Ohio Basic Building Code adopted herein is hereby amended as follows: <br />Special Provisions Applicable to Certificates of Occupancy for Multiple <br />Dwellings Only. ... - - <br />The following. provisions shall apply to certificates of occupancy for multiple <br />dwellings. , .._ ..; <br />(a) Original Certificates. of::Occupancy: - ,: <br />(1) The Original certificate of occupancy shall be granted .by the <br />Building Commissioner if he. finds upon inspection that: the. <br />building or other structure is in compliance with the provision <br />-. of this Code; :and alC other -laws, ordinances; rules= and <br />regulations applicable hereto: The- certificate shall state the <br />:_ <br />.; .. = ; _... __ name and address of the owner, and; if the owner does not.- <br />
