ORDINANCE NO. 98- 36 INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE ACCEPTING THE PROPOSAL OF FIRST ENERGY REGARDING THE NIGHTVISION LIGHTING SERVICES FOR THE ILLUMINATION OF PORTIONS OF NORTH CHAGRIN COMMONS WHEREAS, NightVision is an outdoor lighting service offered to augment the standard street and area lighting program from the Cleveland Electric Illuminating Company; and WHEREAS, the goal of this service is to allow CEI customers to obtain the most cost effective, durable, and high quality lighting systems to meet performance and budgetary requirements of each project; and WHEREAS, Nighti/ision has made a proposal that the illumination of designated portions of North Chagrin Commons and Village Council deems the acceptance of this proposal to be in the best interest of the health, safety, and welfare of all Village residents. NOW, THEREFORE, BE iT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. That the .proposal of First Energy with regards to the NightVision program for the illumination of portions of the North Chagrin Commons, which is attached as Exhibit A, is hereby accepted. SECTION 2. That the Director of Finance is authorized and directed to make appropriate and timely payments from the appropriate fund relative to the total cost of the proposal, not to exceed Three Hundred Forty-One Thousand Six Hundred Dollars ($341,600.00). SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requires-gents of Section 121.22 of the Ohio Revised Code. SECTION 4. This ordinance is hereby declared to be an emergency measure immediately necessary for the health, safety and welfare of the residents of Mayfield Village, Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise at the earliest time allowed by law.
