' ' i~ ORDINANCE NO. 9r3- 40 ' INTRODUCED BY: Mayor Rinker and Council as a Whole AN EMERGENCY ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO ENTER INTO A CONTRACT WITH CAPUTO-MARTINI FOR GENERAL TRADES FOR THE VILLAGE POOL PROJECT WHEREAS, it has already been deemed necessary and in the best interest of the health, safety, and welfare of all of the Village residents to construct a swimming pool for use by Village residents; and WHEREAS,. pursuant to law, bids were advertised by the Village, those bids vrere received, and it was determined that the bid of Caputo-Martini was the best bid. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFiEI_D VILLAGE, OHIO, THAT: SECTION 1. That the Mayor is authorized and directed to enter into a contract with Caputo-Martini fior the general trades for the Village pool project, pursuant to the.bit~5 and specifications as~^advertised by the Village, and pursuant to that company's ~bir~ not to exceed One Million, Four Huridred Sixty Thousand, Five Hundred Seventeen ..Dollars ($1,460,517.00) as received by the Village, which is determined to be the best bid and pursuant to the terms and conditions as set forth in these documents whici~, :shall be maintained by the Director of Finance. SEC'T10('J 2. The. Council finds and determines that all formal. actions of this Council relating to ahe adoption of this Ordinance have been taken at open rneeaings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action,,took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 3.. This Ordinance is hereby declared to be an emercerrcy rr~~eas!are immediately necessary far the health, safety and welfare of the residents of ~i~lc,'yfield Village,.. Ohio. It shall, therefore, take effect immediately upon the passage by the affirmative vote of nofi less than five (5) members elected to Council and approval by tl~e Mayor or other~rvise~at the.earliest time allowed by law.
