' ' i~ <br />ORDINANCE NO. 9r3- 40 ' <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AND DIRECTING THE MAYOR <br />TO ENTER INTO A CONTRACT WITH <br />CAPUTO-MARTINI FOR GENERAL TRADES <br />FOR THE VILLAGE POOL PROJECT <br />WHEREAS, it has already been deemed necessary and in the best interest of the <br />health, safety, and welfare of all of the Village residents to construct a swimming pool <br />for use by Village residents; and <br />WHEREAS,. pursuant to law, bids were advertised by the Village, those bids vrere <br />received, and it was determined that the bid of Caputo-Martini was the best bid. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFiEI_D <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor is authorized and directed to enter into a contract with <br />Caputo-Martini fior the general trades for the Village pool project, pursuant to the.bit~5 and <br />specifications as~^advertised by the Village, and pursuant to that company's ~bir~ not to <br />exceed One Million, Four Huridred Sixty Thousand, Five Hundred Seventeen ..Dollars <br />($1,460,517.00) as received by the Village, which is determined to be the best bid and <br />pursuant to the terms and conditions as set forth in these documents whici~, :shall be <br />maintained by the Director of Finance. <br />SEC'T10('J 2. The. Council finds and determines that all formal. actions of this <br />Council relating to ahe adoption of this Ordinance have been taken at open rneeaings of <br />this Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action,,took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3.. This Ordinance is hereby declared to be an emercerrcy rr~~eas!are <br />immediately necessary far the health, safety and welfare of the residents of ~i~lc,'yfield <br />Village,.. Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of nofi less than five (5) members elected to Council and approval by tl~e <br />Mayor or other~rvise~at the.earliest time allowed by law. <br />
