ORDINANCE NO. 98-41 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AND DIRECTING THE MAYOR <br />TO ENTER INTO A CONTRACT WITH <br />ASTRO POOL FOR POOL WORK <br />FOR THE VILLAGE POOL PROJECT <br />WHEREAS, it has already been deemed necessary and in the best interest of the <br />health, safety, and welfare of all of the Village residents to construct a swimming pool for <br />use by Village residents; and <br />WHEREAS, pursuant to law, bids were advertised by the Village, those bids were <br />received, and it was determined that the bid of Astro Pool was the best bid. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, l'HAT: <br />SECTION 1. That the Mayor is authorized and directed to enter into a contract with <br />Astro-Pool.for. poof~work.for the.Viilage pool.projeet, pursuant to the bids and specifications <br />as.advertisedby the:Viilage and pursuant-to-that.company's bid not to exceed.One Million, <br />One Hundred ~5ixty-Nine .Thousand, Three Hundred' ($1,169,300.00) as _receiw~d by the <br />Village, vrhich~is:..cleterr~ined to:be.the best bid.and pursuant to the terms~and conditions <br />as set-forth- irr these°docurr+ents~which shall- be maintained by the Director of Finance. <br />SECTION 2. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and thafi deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121:22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio.. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law. <br />
