ORDINANCE NO. 98- 47 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE MAYOR AND DIRECTOR OF FINANCE <br />TO ENTER INTO AN AGREEMENT FOR THE <br />ACQUISITION OF THE MT. SINAI EXCESS CEMETERY PROPERTY <br />LOCATED ON THE CORNER OF WHITE ROAD AND S.O.M CENTER <br />WHEREAS, the Administration has been negotiating with the Trustees for Mt. Sinai <br />Cemetery for t he acquisition of land which the cemetery does not anticipate needing for <br />the expansion of its grave sites; and <br />WHEREAS, a fair market value of $375,000.00 has been agreed upon between the <br />Administration and the Trustees of Mt. Sinai Cemetery; and <br />WHEREAS, it is the intention of Council to authorize and Offer to Purchase such <br />property on the basis of three installments over three years, or for $350,000.00 with two <br />installments over two years. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That the Mayor and Director of Finance and Director of Law are <br />hereby and herein authorized and directed to negotiate a Purchase Agreement with the Mt. <br />Sinai Cemetery property for an amount not to exceed $375,000.00, with installments over <br />three years at $125,000.00 per year, or $350,000.00 with installments over two years. <br />SECTION 3. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this <br />Council; and that deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compliance with all statutory <br />requirements including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law. <br />MARK FIXLER <br />Council President <br />
