_ _ RESOLUTION NO. 98-05 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />AUTHORIZING THE MAYOR AND PRESIDENT OF COUNCIL <br />TO ENTER INTO A CONTRACT WITH SNAVELY DEVELOPMENT <br />COMPANY FOR THE REALIGNMENT OF THE BLUEBERRY CIRCLE <br />STORM OUTLET PIPE <br />WHEREAS, the Village has advertised pursuant to law for bids relevant to the <br />realignment of the Blueberry Circle storm outlet pipe; and <br />WHEREAS, the Engineer has analyzed the bids, and recommends Snavely <br />Development Company as the lowest and best bid. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. That the Mayor is hereby and herein authorized and directed to <br />enter into an agreement, along with the President of Council, with Snavely Development <br />Company for the realignment of the Blueberry Circle storm outlet pipe in Mayfield Village, <br />pursuant to their bid proposal attached hereto and incorporated herein as Exhibit "A", as <br />well as all engineering specifications and plans. <br />SECTION 2. The Director of Finance is authorized to make payment for the <br />project described in Section 1 hereof, in an amount not to exceed $17,810.00. <br />SECTION 3. The Council finds and determines that all formal actions of the <br />Council relating to the adoption of this Resolution have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public in compliance with all <br />statutory requirements including the requirements of Section 121.22 of the Ohio Revised <br />Code. <br />SECTION 4. This Resolution is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the health, safety and welfare of the <br />residents of Mayfield Village. It shall, therefore, take effect immediately upon passage <br />by the affirmative vote of not less than five (5) members elected to Council and approval <br />by the Mayor or otherwise at the earliest time allowed by law. <br />MARK F CLER, <br />Council President <br />
