RESOLUTION N0.~2008-10 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION DESIGNATING MARY E. BETSA <br />AS VILLAGE COUNCIL AND THE MAYOR' S DESIGNEE TO RECEIVE <br />PUBLIC RECORDS TRAINING ON BEHALF OF EACH OF THE ELECTED OFFICIALS <br />PURSUANT TO AND IN ACCORDANCE WITH <br />OHIO REVISED CODE SECTION 109.43(B) AND 149.43(E)(1) <br />WHEREAS, recent changes in Ohio's Public Records Law, specifically Ohio Revised Code <br />Section 109.43(B) and 149.43(E)(1), require that officials elected to statewide or local office receive <br />three hours of Public Records training for each term of office; and <br />WHEREAS, if the elected official so chooses, the Public Records Law allows a designee to <br />be appointed to receive the training on the elected official's behalf; and <br />WHEREAS, the designee must be an employee in the public office and there must be <br />evidence of the designation; and <br />WHEREAS, if there is more than one elected official in the public office, the designee should <br />be the designee of all the elected officials within the office. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. In accordance with Ohio's Public Records Law, Ohio Revised Code Section <br />109.43(B) and 149.43(E)(1), Village Council and the Mayor hereby and herein appoint Mary E. <br />Betsa as their designee to receive the requisite Public Records training on their behalf. <br />SECTION 2. This Resolution shall stand as evidence of Mary E. Betsa's appointment as the <br />designee by Village Council and the Mayor for all terms of office including the years 2007 and 2008. <br />SECTION 3. The Council finds and determines that all formal actions of the Council relating <br />to the adoption of this Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such formal action, took place in <br />meetings open to the public in compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Resolution is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the health, safety and welfare of the residents of Mayfield Village. It <br />shall, therefore, take effect immediately upon passage by the affirmative vote of not less than five (5) <br />
