ORDINANCE NO. 2014-22 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGE1o1CY ORDINANCE <br />AiJTHORIZING AND DIREC'I'ING <br />THE NIAYOR AND PRESIDENT OF COiJNCIL <br />TO ENTER INTO THE FIRST AIVIENDME1oTT <br />TO SITE LICENSE AGREEMENT. <br />WHEREAS, Licensee and Licensor entered into a Site License Agreement on or about <br />July 5, 2011; and <br />WHEREAS, the Licensor, as the owner of a tower and building, provided a site license to <br />Licensee to access the tower and building for the installation and location of certain equipinent <br />described in the Site License Agreement, to be located on a portion of Licensor's property; and <br />WHEREAS, at this time it has become necessary to further address the shared <br />maintenance of certain Equipment being jointly used by Licensee and Licensor and to update the <br />Equipment list to include certain air handling equipment that has been installed, upgrading the <br />former air handling equipment; and <br />,- `WHEREAS, this First Amendment is also necessary to acknowledge that the Site License <br />Agreement has been automatically renewed for an additional two (2) year term through June 30, <br />2015. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. Council authorizes the Mayor and President of Council to enter into a First <br />Ainendment to Site License Agreement, a copy of which is attached hereto and incorporated <br />herein by reference as Exhibit "A", on behalf of the Village. <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, resulting in such formal action, took <br />place in meetings open to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />iinmediately necessary for the health, safety and welfare of the residents of Mayfield Village, <br />Ohio.
