ORDINANCE NO. 2017-10 <br />INTRODUCED BY: Mayor Bodnar and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AND DIRECTING THE MAYOR AND PRESIDENT OF COUNCIL <br />TO ENTER INTO A PURCHASE AGREEMENT <br />TO PURCHASE THE REAL ESTATE <br />LOCATED AT 570 S.O.M. CENTER ROAD <br />WHEREAS, the real estate located at 570 S.O.M. Center Road, Mayfield Village, Ohio <br />sits in proximity of two (2) separate retention basins, the Palermo Basin and Wiley Basin; and <br />WHEREAS, the Village intends to purchase the real estate in order to accommodate the <br />expansion of existing retention basin areas; and <br />WHEREAS, the current owner of that property, Elaine Underwood, is in agreement to <br />sell the Village her real estate; and <br />WHEREAS, Council deems it necessary and in the best interest to the health, safety and <br />welfare of all Village residents to enter into a Purchase Agreement with Elaine Underwood. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of Mayfield, <br />County of Cuyahoga, State of Ohio: <br />SECTION 1. The Council of Mayfield Village, Ohio hereby authorizes and directs the <br />Mayor and President of Council to enter into a Purchase Agreement with Elaine Underwood as <br />set forth in the document attached hereto and incorporated herein by reference as Exhibit "A". <br />SECTION 2. The Council finds and determines that all formal actions of the Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; and <br />that deliberations of this Council and of its committees, resulting in such formal action, took <br />place in meetings open to the public in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure necessary <br />for the immediate preservation of the health, safety and welfare of the residents of Mayfield <br />Village. It shall, therefore, take effect immediately upon passage by the affirmative vote of not <br />
