Agree»:ent bet-neen Mayfield Village and F.O.P. Lodge 57 <br />Section 40.7. After hearing the parties, the arbitrator shall resolve the dispute between the parties <br />by selecting on an issue-by-issue basis from between either of the party's final offers, taking into <br />consideration the following: <br />A. Past collective bargain agreements, if any, between the parties; <br />B. Comparison of the issues submitted to binding arbitration relative to the employees in <br />the bargaining unit involved with those issues related to other public and private <br />employees doing comparable work, giving consideration to factors peculiar to the area <br />and classification involved; <br />C. Comparability of treatment between the employees in the bargaining unit in question <br />and the Village's employees doing work comparable to that performed by bargaining <br />unit employees, concerning the issues submitted to binding arbitration; <br />D. The interests and welfare of the public, the ability of the employer to finance and <br />administer the issues proposed, and the effect of the adjustments on the normal standard <br />of public service; <br />E. The lawful authority of the employer; <br />F. The stipulations of the parties; and <br />G. Such other factors, not confined to those listed in this Section, which are normally or <br />traditionally taken into consideration in the determination of the issues submitted to <br />binding arbitration through voluntary resolution procedures in the public service or in <br />private employment. <br />Section 40.8. The arbitrator shall make written findings of fact and promulgate a written opinion <br />and award upon the issues presented to him, and upon the record made before him and shall mail <br />or otherwise deliver a true copy thereof to the parties. <br />Section 40.9. Increases in rates of compensation and other matters with cost implications awarded <br />by the arbitrator will be effective at the end of the term of the preceding agreement. <br />Section 40.10. All awards of the arbitrator are subject to review by the Court of Common Pleas <br />having jurisdiction over the public employers as provided in Chapter 2711 ®.R.C. <br />Section 40.11. The award of the arbitrator is final, conclusive and binding on the Employer and the <br />F.O.P. and it is a mandate to both parties to take the necessary steps to implement the award, unless <br />the parties mutually agree to amend or modify the award. <br />36 <br />
