ORDINANCE NO. 2017-30 Page 2 NOW, THEREFORE, BE IT ORDAINED by the Council of the of Mayfield, County of Cuyahoga, State of Ohio: r Section 1. For the purpose of this Ordinance, "medical marijuana" shall have the same meaning as that term is defined in Ohio Revised;~Code Section 3796.01(A)(2) as adopted by H.B. 523. f~ Section 2. This Council establishes an additional :moratorium on the acceptance of any application for, or granting of, any zoning certificate for any building, structure, use, expansion of use, or change of use that would enable the cultivation, processing, distribution or sale of medical marijuana in the Village of Mayfield for a period of 180 days from the date the pr"'or moratorium adopted by Council expires. ;' Section 3. No existing business in the Village may expand in any way that would establish the cultivation, processing,'`~distribution or sale of medical marijuana for the duration of said moratorium~period. Section 4. Should Council not adopt regulations by the time on which the moratorium period expires, the following shall become effective: X~~X.XX PROHIBITION ;~`OF PROCESSING OR RETAIL DISPENSARIES OF MEDICAL MARIJUANA ;' Medical marijuana cultivation, processing and/or retail distribution as authorized by the Ohio~Revised Code Section 3796, is hereby and herein prohibited in all~`zoning districts within the Village of Mayfield pursuant to the author.-ity granted by the Ohio Revised Code under R.C. § 3796.29. F`~1 Section 5. The r~ouncil finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in complia~ice with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
