ORDINANCE NO. 2016-26 <br />INTRODUCED BY: Mayor Bodnar and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE MAYOR TO ENTER INTO <br />A NATURAL GAS SALES AGREEMENT WITH <br />NEXTERA ENERGY SERVICES OHIO, LLC <br />IN ORDER TO ENROLL IN A GAS ENDORSEMENT PROGRAM <br />WHEREAS, NextEra Energy Services Ohio, LLC, in coordination with the <br />Northeast Ohio Public Energy Council ("NOPEC") has created a gas endorsement <br />program for certain accounts that no longer qualify for NOPEC's gas aggregation <br />rate; and <br />WHEREAS, Mayfield Village currently has five (5) gas accounts that would <br />qualify for,the gas endorsement program being offered by NextEra Energy Services <br />Ohio, LLC; and <br />WHEREAS, it is the desire of Mayfield Village Council to enter into the gas <br />endorsement program with NextEra Energy Services Ohio, LLC to allow the Village <br />to obtain the benefit of a lower rate(s). <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF <br />MAYFIELD VILLAGE, OHIO THAT: <br />SECTION 1. Council hereby authorizes the Mayor to enter into a Natural <br />Gas Sales Agreement to enroll the five (5) gas accounts that would qualify for the <br />gas endorsement program offered by NextEra Energy Services Ohio, LLC, as set <br />forth in the Agreement attached and incorporated by reference as Exhibit "A." <br />SECTION 2. Council .finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings <br />of this Council; and that deliberations of this Council and of its committees, <br />resulting in such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements of Section <br />121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the health, safety and welfare of the residents of <br />
