ORDINANCE N0.2016-36 <br />INTRODUCED BY: Mayor Bodnar and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AND DIRECTING THE MAYOR <br />TO ENTER INTO A MEMORANDUM OF UNDERSTANDING <br />WITH THE NORTHEAST OHIO REGIONAL SEWER DISTRICT AND <br />THE CUYAHOGA SOIL AND WATER <br />CONSERVATION DISTRICT FOR <br />THE IMPLEMENTATION OF THE PUBLIC INVOLVEMENT <br />AND PUBLIC EDUCATION ("PIPE") UNDER THE <br />OHIO EPA MUNICIPAL SEPARATE <br />STORM SEWER DISCHARGE (MS4 PERMIT) <br />WHEREAS, the Northeast Ohio Regional Sewer District recognized the Cuyahoga Soil & <br />Water Conservation District as a Preferred Service Provider for the implementation of the Public <br />Involvement and Public Education (PIl'E) under the Ohio EPA Municipal Separate Storm Sewer <br />Discharge (MS4) Permit; and <br />WHEREAS, under the MS4 permit, Mayfield Village is required to develop, implement, and <br />enforce a Stormwater Management Plan that addresses six Minimum Control Measures, outlined in <br />Exhibit A attached hereto; and <br />WHEREAS, criteria for the PIPE Program is to identify stormwater pollution concerns, have <br />measurable goals, reach a variety of audiences, actively involve potentially affected stakeholder <br />groups, and evaluate the program's success. All of this must be reported annually to the Ohio EPA; <br />and <br />WHEREAS, the purpose of the Memorandum of Understanding with the Cuyahoga Soil & <br />Water Conservation District is to facilitate the implementation of the PIPE program; and <br />WHEREAS, Mayfield Village wishes to acknowledge the terms of the Memorandum of <br />Understanding between the Cuyahoga Soil & Water Conservation District and the Northeast Ohio <br />Regional Sewer District and Mayfield Village; and <br />WHEREAS, further, the Village wishes to authorize the Mayor to enter into a Memorandum <br />of Understanding with the Cuyahoga Soil & Water Conservation District and the Northeast Ohio <br />Regional Sewer District committing the Village to the goals of the Cuyahoga Soil & Water <br />Conservation District and authorizing financial participation by the Village in the annual amount of <br />five thousand five hundred dollars ($5,500). <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, <br />OHIO, THAT: <br />SECTION 1. The Mayor is authorized and directed to enter into a Memorandum of <br />Understanding with the Cuyahoga Soil & Water Conservation District and the Northeast Ohio <br />Regional Sewer District as more fully set forth in Exhibit "B" attached hereto and incorporated <br />herein by reference. <br />
