Mayor Endress then reported that iae had for eonsideration the re-zoning <br />of certain property on S.O.M.<Center Road, a part o£ Aintree Park for Apartment <br />Houses and Ordinance No. 705 had been placed on its second reading at our <br />regular meeting in biay. As this had not been stated as clearly as it should <br />have been, it was moved by Mr. Wedler, seconded by Mr. Grootegoed, that our <br />Minutes of May 15, 1961, be corrected to show that Ordinance No. 705 had been <br />read at this-regular meeting. Roll-Call: Ayes - Messrs Zorn,Wedler,Bennett,Brown,Grootegoed & Belzero <br />Nays - None. <br />Motion carried <br />? <br />Mr. Edelman again read Ordinance No. 705 to Council which placed this <br />ordinance on its third reading. <br />It was then moved by Mr. Wedler, seconded by Mr. Zorn, that the rules <br />of 1aw requiring an ordinance to be_re.ad on three separate occasions be suspended. <br />Roll Call: Ayes - Messrs Zorn,Wedler,Bennett,Brown,Grootegoed & Belzero <br />Nays - None. - <br />? Motion carried <br />Rules Suspended <br />At this point Mre Stannard adclressed Council and said that he was sure <br />that Council did not wish to do anythi.ng hastily and, as there was a strong <br />possibility, due to deed restr-ictionsy that this property could not be used <br />f or anything but strictly residential purposes and that he did not think <br />that anyone had seen all the documents on this property and, theref ore, Council <br />should thinlc twice on the mattero Mr. Edelman said that he had consulted every <br />known legal possibility and every source available on the matter and was convinced <br />that this property could be re-zoned f or the purpose without any question of <br />violation of deed restrictions, inasmuch as the owner of over 55% of the land <br />covered by the restrictions in question has power to waive them and has done so. <br />It was then moved by Mr,•Wedler, seconded by Mr. Bennett, that Ordinance <br />No. 705 "Ari Ordinance to Amend the Zoning Ordinance of the Village of Nlayfield <br />by Transferring Certain Proper'ty on the West Side of S.O.M. Center Road to a <br />Class U-3 Use District ( Apartment House)"Be Approved "and Passed as read. <br />Roll Call; Ayes - Messrs Zorn„Wedler,Bennett,Brown,Grootegoed & Belzer, <br />?
