Ma.n.utes of the Special Meeting <br />June 2, 1958 <br />The Counci.l. of t,he Village of Mayfield met in Special Meeti.ng at the Vi1l.age <br />Ha1L at 8:00 P. M. pursuant to notice given to a17.members of Council qccord.3.ng to <br />law. Mayar Endress presiding. <br />Rolll. Call: Present - Messrs St,rater9 Browm., Zorn9, and Hopkins. Mr. Wecller <br />came late o - <br />Absent - Mr, Tayloz°, <br />Mayor Endress then advised Counci7; that th.e reason for the Special Meeting <br />was that he had found that DeFranco was stripping the top so1l from his a].7.otment <br />and sel].ing ito Mayor Endress said that he had checked and found that we did <br />not have an ordinance covex°a.ng this phase of the rnatter and had asked Mr. Ed.e7.man <br />to.check with the other sol.icitors and see what kird of ordinances regu3.ated this <br />matter and whether it was legal. . <br />Mre Edelman.sagd that he remembered working on a top soil ordinance years <br />ago, but nothz.ng came of it, NZr. Edelman said that Cleveland Heights did not <br />have such an ordinance, but Highland Heights proh:lbi.t,ed the removal of top soil <br />except in the bia.siness distx°ict and had this ordinance in its Zoning Ordinanee. <br />N1ro Ede]man then said that there were a couple of ord.inances that had loeen upheld <br />by the ceurtm . These ond,inances permitted the removal Qf top soil. by license; <br />they were checkecZ by the Bt2ilding Inspectox° and t,he Vill.age Eng3neero F"i..r°st' a <br />bond of $500,,00 per acre is requiredo Then' as in Brook].yn Height,s, a,fee of <br />$50.00 per acre is charged for a license• MPo Edelman said that he had prepared an ordinance arxl proceeded to read <br />this ordinance to Couneil. Mr. Zorn said that he would like to see added in . <br />section £aur., the sentence "No1c top soil necessar°y to remove in the construction <br />of a road." Mr. Fde]man said that this could be doneo <br />Mr. Hopkins, secanrted by MI•. Strat,er, t,hen introduced Ordinance No. 624 <br />entitledv "An. Ordinance Regu].ating the Removal of Top Soi7., Zoam, Sand ard <br />Gravel With-in fhe Village.of kZayfie3.d", which ordinance was read to Counca.l. <br />Mre Edel.man then read another ordinance relative to ctzrbs on Wilson Mi71s <br />Roado, 2'here was some ques-tion iri Council°s mird as the Crnznty had said that <br />everyone had to cut irito the sewer and it was -vond.ered i.f this ordinance dad <br />not imply an opticn to do so, Mayor End.ress said that perhaps the County would <br />not like tha.s ki.nd of an ordinance 9 that Highland Height,s did not Yiave the <br />mvney to make the necessary moves required to widen Wilson Mi11s' b ut that he <br />did not think the County was goi.ng f,o let it rest there. <br />Mr. Hopkins, seconded by Mre Strater, then introduced Ordinance -No. 625 <br />entit7.ed:."An Ordinance to Levy Speci.al. Assessments for the Improvement of Zander <br />Road in the Vi].].age of Mayfield Ohio fram G,Ti.].son Mz13s Road in a Southerly Direction <br />to the South Cox°porati.on Line of the Vi1.lage of Mayfield' Ohio9 by the Constrezction <br />of a Water Main and Appurtenances Therein"$ which ordinance was read to Council. <br />As Mr, Wedl.er was due to arrive momentarily' it was moved by Mr. Strater., <br />sECOxrded by I"Ir.
