~~~ <br />.'MINUTES OF A SPECIAL MEETING OF COUNCIL <br />Village of Mayfield <br />August 30, 1979 <br />The Council of the Village of Mayfield met in Special Session on <br />Monday, August 30, 1979 at 8055 P.M. a;n the Village Hall pursuant <br />to notices being delivered on August 29, 1979. Council President <br />Busa, presided. <br />Present: Messrs., Boger, Busa, Grogan, Mrs. Hanus, and Miss Trask <br />Absent: Messrs., Bennett, Flynn <br />Also Present were: Mayor Beebe, Dale Feneli, Gus Amendola, Steve <br />Hovancs:ek <br />Mr. Busa stated the purpose of the meeting is: (1) To appoint an <br />equalization board as a result of objections received regarding the <br />proposed assessemnt for the resurfacing of Echo Drive;.(2) To give <br />authorization to advertise for bids for work to be done in the ease- <br />ment at 6826 Meadowood Drive. <br />Equalization Board <br />Mr. Feneli explained the reason for the equalization board to the <br />prospective, board members. In summation, residents of Echo Drive <br />(85/) approached Council with a signed petition requesting the re- <br />surfacing of Echo Drive. In accordance with the Ohio Regional Code, <br />the Village Engineer prepared an estimate of the cost of this improve- <br />ment. Several meetings took place with the Engineer and some of the <br />residents on Echo Drive. The Engineer was asked to prepare an estimate <br />that-would give a satisfactory road at the least possible assessment <br />to the residents. The total estimated cost would be dVi~aed~~among the <br />residents that abutted Echo Drive.- 192 units at approximately $4500 <br />per whole unit. Council reviewed the estimate and judged it to be <br />fair and passed a "Resolution of Necessity" according, to law. Cert- <br />ified letters of notification were sent to the residents stating a <br />14 day objection period allowance. Two objections were received, thus <br />the need for the equalization board. In accordance with the Ohio Re- <br />gional Code, three disinterested parties is to be appointed and a cer- <br />tified notice of the meeting to be sent to the objectors. A five day <br />waiting period is mandatory form the date of mailing the notices. Re- <br />quired participants of the meeting are: <br />Village Engineer and Law Director (for verification of any questions) <br />Equalization Board <br />It is not mandatory, but the objectors will probably attend along with <br />possible counsel, Mayor Beebe and Council Members. <br />The equalization board has the power to decide what, in their opinion <br />is fair and are to make them recommendation in writing to Council. If <br />they chose they can approve., disapprove or modify the assessment. <br />Mr. Hovancsek explained that there is three ways of determining an assess- <br />ment: <br />
