G~ Ro11 Call: RYES: Messrs., Barclay, Bennett, Ficken, Mrs. Negrelli and Mr. Prager NAYS: None ABSTAIN: Mr. Schulte Motion Carried Appointment Confirmed Mr. Prager, confirmed by Solicitor Byrnes, advised it was not necessary to swear in the Village Hall Department Heads. Resolution 872; entitled, "A RESOLUTION ESTABLISHING WORK PERIODS, PAYMENT FOR OVERTIME AND EXECUTIVE EXCEPTION FOR PERSONNEL IN THE POLICE AND FIRE DEPARTMENTS, BUILDING COMMISSIONER AND ADMINISTRA- TIVE ASSISTANT, AND DECLARING AN EMERGENCY", introduced by Mr. Prager. Mayor Leech commented this Resolution was in conjunction with the "Fair Labor Standards Act" enacted May 1, 1974 requiring time and one-half for all public employees. The Police and Fire Personnel schedules are based on a 40 hour week over 7 days which is 8.6 hours per day and during that period any employee who exceeds a maximum 240 hours over. a 28 day period total will be paid time and one-half. Further that executives may be excluded from the provisions of the Act. Mr. Bennett asked what constituted an "executive" to which the Mayor explained, any person who directs two or more employees (including himself) has authority to hire and/or fire, etc. Mr. Barclay asked_if such a definition should not be included in the Ordinance to which the Solicitor replied the Ordinance makes direct reference to the "Fair Labor Act" which so spells it out. Mr. Bennett, seconded by Mr. Schulte, made a motion to suspend the rules of law requiring a Resolution be read on three separate occasions.
