G~ <br />Ro11 Call: RYES: Messrs., Barclay, Bennett, Ficken, <br />Mrs. Negrelli and Mr. Prager <br />NAYS: None <br />ABSTAIN: Mr. Schulte <br />Motion Carried <br />Appointment Confirmed <br />Mr. Prager, confirmed by Solicitor Byrnes, advised it was not <br />necessary to swear in the Village Hall Department Heads. <br />Resolution 872; entitled, "A RESOLUTION ESTABLISHING WORK PERIODS, <br />PAYMENT FOR OVERTIME AND EXECUTIVE EXCEPTION FOR PERSONNEL IN THE <br />POLICE AND FIRE DEPARTMENTS, BUILDING COMMISSIONER AND ADMINISTRA- <br />TIVE ASSISTANT, AND DECLARING AN EMERGENCY", introduced by Mr. Prager. <br />Mayor Leech commented this Resolution was in conjunction with the <br />"Fair Labor Standards Act" enacted May 1, 1974 requiring time and <br />one-half for all public employees. The Police and Fire Personnel <br />schedules are based on a 40 hour week over 7 days which is 8.6 <br />hours per day and during that period any employee who exceeds a <br />maximum 240 hours over. a 28 day period total will be paid time <br />and one-half. Further that executives may be excluded from the <br />provisions of the Act. Mr. Bennett asked what constituted an <br />"executive" to which the Mayor explained, any person who directs <br />two or more employees (including himself) has authority to hire <br />and/or fire, etc. Mr. Barclay asked_if such a definition should <br />not be included in the Ordinance to which the Solicitor replied the <br />Ordinance makes direct reference to the "Fair Labor Act" which so <br />spells it out. <br />Mr. Bennett, seconded by Mr. Schulte, made a motion to suspend the <br />rules of law requiring a Resolution be read on three separate <br />occasions. <br />Roll:Ca11: AYES: Messrs., Barclay, Bennett, Ficken, Mrs. Negrelli <br />and Messrs., Prager and Schulte <br />NAYS: None <br />Motion Carried <br />Rules Suspended <br />Mr. Bennett, seconded by Mr. Schulte, made a motion to adopt <br />the Resolution. <br />Roll Call: AYES: Messrs., Barclay, Bennett, Ficken, Mrs. Negrelli <br />and Messrs., Prager and Schulte <br />NAYS: None <br />Motion Carried <br />Resolution Adopted <br />
