The resolution was discussed with an insertion of "notice of appeal and appeal"':between "judgement" and "entered." DIr. Byrnes said it was his recommendation to Council to pass the Res. ;~7r. Barclay said the Resolution should be changed and put on the agenda for Thursday night. Resolution 995;.Given First Reading. Resolution 996, entitled; "~ RiSOLUTIOT~ IN ACCORDI~_NCE T~ITri AI2TICLE III, SLCTTOTd 1G, OF THE VILL.~Gr; CHARTEtZ TO Ei~-2PLOY SPECI~zL LEGAL COUNSEL r'LND PROVIDING COMPENSATION THEREFOR," was introduced by I~Ir. Grogan and given First I~.eading. Dir. Byrr_es said that it was the practice of this community that Resolu- tions and Ordinances be prepared by the Village Law Director and Reso- lution 996 had not been and felt it was not according to the statutes of the State of Ohio. I~ir. Grogan said the Resolution had been drawn up by an outside Counsel. I~1r. Barclay said every ordinance and resolution should be presented to the I~~Iayor and if any Councilman voted for this resolution in its pre- sent form is not upholding the Charter. Mr. Grogan said article IIT, Section 16 gave ]zim the authority. I~~layor Beebe said that the headline in tonights Press said Council was suing the I~iayor (in reference to P.esolution 966). Dlayor Beebe asked Council D'iembers if they were suing him? I2essrs., Barclay, Bordonaro, and Schulte replied no. I•Iayor Beebe said under Section 1 of this resolution, where is the $4,000 coming from to pay T~1r. Or]tin, or vahoever the outside legal Counsel is? I~Ir. Grogan said out of the $30,000 appropriated by Council for legal fees and said all could be settled if the I•!ayor would appoint the new Law Director tonight. .Mayor Beebe said he ~~as going by the laws of the Village and there was no time limit set. Also, as he has stated before, the pending litiga- tion cases if turned over to a new Laia Director would cost the Village too. much money as well as time. iLiayor Beebe asked I•Ir. Grogan why he was willing to spend $4,000 to fight him when all he was trying to do was save the Village money. Mayor Beebe stated he did not agree with Section x of the resolution. Resolution 997, entitled; "~ RESOLUTION DESIGNATING FINANCIAL INSTI- TUTIONS AS PUBLIC DEPOSITOP.IES AND D~CLAP.ING AN E1~i~RGENCY" , was intro- duced by Mr. Busa.
