~.~~ <br />MINUTES OF SPECIAL MEETING <br />Village of Mayfield Village <br />September 27, 1977, <br />The Council of Mayfield Village Met:iin Special Session at the Village <br />Hall on Tuesday, September 27, 1977 at 8:00 P.M. pursuant to Special <br />Meeting Notices delivered to all Councilmen on September 20, 1977. <br />Council President, Robert Grgoan presided. <br />The Pledge of Allegiance to the Flag was given. <br />Roll Call: Present: Messrs., Barclay, Bennett, Borclonaro, Busa, <br />Flynn, Grogan and Schulte <br />Absent: None <br />Also Preseia;t were: Mayor Beebe, Messrs., Amendola, Byrnes, Hovancsek <br />and Relic <br />Mr. Grogan stated this meeting was called for the purpose of discussion <br />of litigation matters and any other matter that may come before Council. <br />Mr. Grogan stated that a hearing was scheduled for November 17, 1977 at <br />1:00 P.M. in the Justice Center on the original transcript of the meeting <br />of June 28, 1977 concerning Mr. Edward Henry. <br />Mr. Busa, seconded by Mr. Flynn, made a motion to cast a vote of con- <br />fidence to the Board of Appeals and Architectural Review Board by letting <br />the record stand as is with hopes to minimize expenses. <br />Mr. Barclay stated that the decision made by the Judge would be based on <br />the transcript of one meeting. Since there were several meetings held, <br />concerning the subject, at which only the-bare legal facts were recorded, <br />he felt an attempt should be made to have additional information pre- <br />sented to the Judge. <br />Mr. Bordonaro asked Mr. Byrnes if additional information would be bene- <br />ficial? <br />Mr. Barclay said at the Executive Session Council had discussed this and <br />felt additional information would be important. <br />Mr. Byrnes said tlae~ceeis a collateral issue if a brief shcsid be filed by <br />the Village in opposition to .the Henry's. <br />Mr. Grogan said there would be o3~jection raised by the Courts if addi- <br />tional information were to, be injected. <br />Mr. Grogan stated that the Boards and Commissions of the Village have <br />acted extensively to accomodate the Henry's even thoughtthe vote was <br />not in their favor. He said the first set of plans submitted by the <br />Henry's had been approved. <br />Mr. Barclay stated the Judge is going to make~a decision on what the <br />Henry's have submitted. He felt this was no backing of the Board of <br />Appeals and the Architectural Review Board if no additional information <br />of the other meetings held by them was not made available to the Judge. <br />
