The Law Director shall attend all Village meetings insofar <br />as possible, and shall personally handle the time in Court <br />for litigation. The Law Director's further obligations to <br />the Village shall be as set forth by him in a letter to ::~ <br />Robert Beebe, Mayor, dated September 21, 1977. <br />Nir. Barclay suggested an amendment to Item 1: (to read as follos) <br />"That all presently pending law suits involving the Village as <br />represented by Larry Byrnes, including those on appeal, shall be <br />turned over to Mr. Avery." <br />Mr. Grogan stated the most urgent law suit presently is the Palermo <br />case in c~hich a file of plea must be presented by November 15th. <br />rlr. Barclay questioned if there are any cases Mr. Avery could not <br />handle, in which case would Spieth, Bell, McCurdy & Newell be recom- <br />mended? <br />Mr. Grogan replied it would depend on Mr. Avery's recommendations. <br />Mayor Beebe gave a brief description of Mr. Avery's experience. He <br />also stated that the present Law Director, Mr. Byrnes, would resign <br />at time motion is confirmed. <br />I~Ir. Busa, seconded by Mr. Bennett, made a motion to Table the <br />motion so that Council could have more time to compare Mr. Grogan's _. <br />motion with the Mayor's comments and also have a:chance to meet <br />Mr. Avery. . <br />Mr. Grogan asked for a roll call to table the motion: <br />Roll Call: AYES: Messrs., Bennett and Busa <br />NAYS: Messrs., Barclay, Bordonaro, Flynn, Grogan and <br />Schulte <br />Motion to Table Defeated <br />Mr. Bennett asked if Mr. Avery deciders he cannot handle a certain law <br />suit, does it go back to Mr. Byrnes and would he be willing to assume <br />this responsibility. <br />Mayor Beebe answered the law firm of Spieth, Bell, McCurdy and Newell <br />would be willing to carry on if we so decided. <br />Mr. Grogan stated it requires a Specific Ordinance by Council. <br />Mr. Relic pointed out that Council can appoint certain counsel for <br />litigation. <br />Mr. Busa questioned if Mr. Avery can handle this position since he <br />is already Law Director for two other cities. Can he give us his <br />full attention or are we buying another lawyer at basically a higher <br />fee. <br />
