129 <br />f <br />L <br /> <br />Regular Council Meeting <br />7/15/91 <br />Page Nine <br />First Reading of Resolution No. 91-64, entided; "A Resolution accepting the final plat for Village <br />Trails Subdivision No. 3 and declaring an emergency." Introduced by Mayor Caimen and Council <br />as a Whole. <br />Mr. Ramos said this is the last part of the subdivision; a very small portion of it is in Mayfield <br />Village. <br />Mr. Flynn said he thought the Village was going to get something from Gates Mills regarding their <br />responsibility as far as their acceptance of the roads, etc. <br />Mr. Ramos said the only part of that subdivision in Mayfield Village is frontage. <br />Mayor Carmen said they met with Mayor Collister and the Gates Mills Law Director. Because the <br />houses will set in Gates Mills our initial thought was that Gates Mills would pay us a portion of <br />real estate taxes. He said he explained to the Gates Mills officials that the Village will have no <br />liability if it cannot get in for police or fire protection and they said that is fine. <br />Mr. Flynn said it is his personal feeling that he would like to see the acknowledgment and waiver <br />telling us telling them you are on your own; you are in Gates Mills. What is weight or value of our <br />approving Subdivision No. 3 <br />Mr. Pietrafese said the Village does not have any obligation to Gates Mills residents. <br />Mayor Carmen confirmed that and said that there are no structures in Mayfield Village within <br />Phase 3. <br />Mrs. Cinco, seconded by Mrs. Mills, made a motion to suspend the rules of Council requiring a <br />resolurion to be read on three separate occasions. <br />ROLL CALL: AYES: All <br />NAYS: None <br />Motion Carried <br />Rules Suspended <br />Mr. Ferrante, seconded by Mr. Pietrafese, made a morion to adopt Resolurion No. 91-64. <br />Mr. Ramos said the Village has talked to them about police and fire protection, snow removal, etc. <br />He explained that Gates Mills has taken a"hands-off" attitude and has said that the residents are on <br />their own. Mr. Ramos said he sent a letter to Gates Mills saying that since they have said they are <br />on their own that they will hold Mayfield Village harmless if its emergency vehicles cannot get <br />through because of road conditions. The letter was sent to their Law Director and to Mayor <br />Collister. It was signed by Mayor Collister stating that the Village will not be held liable. Mr. <br />Ramos said he will provide copies of the letter for Council. <br />Mr. Flynn said that since Council has a special meeting scheduled shortly, maybe they could iron <br />out these questions and consider the legislation then. <br />Discussion was held.
