Special Council Meeting <br />6/7/93 <br />Page Four <br />Mrs. Cinco said when they started going over the wage ordinance two issues were <br />being debated. Because of the 4-3 vote to include this item in the wage ordinance, at <br />that time she said it would be included; and she told everyone at that time that she <br />would be voting no (if that section was included.) It comes down to a matter of <br />interpretation of our Charter. What one sees as compensation another sees as <br />reimbursement. She quoted from the Charter (Section 7) regarding compensation. <br />Mr. Fixler said he does not think when the Charter was written it was intended that if <br />someone would have extra expenses that they should not be reimbursed. What would <br />be the difference whether someone turns in a parking voucher or turns in a voucher for <br />day care? Mr. Fixler said since this is a two-year package, they are not looking at that <br />many dollars, and it is up to the individual Councilperson to accept it or not take it. <br />If they do not feel comfortable taking it, then they should not take it. On the other hand, <br />if you have an extra expense to attend litigation, he does not have a problem (with <br />reimbursement). He thinks that people should not have take money out of their pocket <br />to attend extra litigation meetings. <br />Mayor Rinker said he thinks that when they talk about expenses, he thinks that will not <br />add up to that many dollars. If the reimbursement is for time spent away from other <br />employment, this is seen as a compensation for time. He thinks if there are any <br />hardships, they can treat those matters with discretion, however if they write into the <br />ordinance they will be reimbursed they will be setting a precedent that someone may <br />submit a voucher of "x" hours to be compensated for that time. He said he thinks the <br />Charter is very clear on that point. He thinks compensation per hour is wrong and he <br />think it defies the Charter. <br />Mr. Flynn asked if Mayor Rinker felt elected officials should be paid for jury duty as <br />employees are. <br />Mayor Rinker said he feels they should be. The Country operates by Federal, State, <br />County and Municipal laws. The Charter is our Constitution. Council is pledged to <br />uphold the Charter. He does not feel it is correct to make an analogy to jury duty. <br />Mr. Flynn said there is a trial coming up and he may be subjected to 4 days testimony. <br />He does not feel that people are asking him to donate 4-5 days full-time work. He <br />asked how the Mayor felt about participating in the hospitalization. <br />Mrs. Cinco said that is not the point and asked to get back to discussion regarding the • <br />wage ordinance. <br />Mr. Fixler asked Mr. Diemert if this section is comprising the Charter, in his opinion.
