MINUTES OF A SPECIAL MEETING OF
COUNCIL AS BOARD OF APPEALS
Mayfield Village
October 4,1993
The Council of Mayfield Village met in Special Session on Monday, October 4,1993, at
8:10 p.m. in the Council Chambers at the Village Hall. Council President joanne M.
Cinco presided.
ROLL CALL: Present: Mr. Basile, Mr. Busa, Mrs. Cinco, Mr. Ferrante, Mr. Fixler,
Mr. Flynn, and Mrs. Leppla
Absent: None
Also Present Were: Mayor Rinker, Mr. Amendola, Mr. Brett, Mr. Diemert,
Mr. Hovancsek and Mr. Cappello, Chief Mohr, and Miss Heath
Mr. Brett Goldberg of D.O. Summers (in the audience), said they are asking for a
variance to not have to insulate the walls on the existing store down the street. He
explained they create a lot of heat. They must run exhaust fans 12 months a year to
keep themselves comfortable. Also, they do not operate the heat at night. To add more
insulation would cause problems for them.
Mayor Rinker asked what is recommended for insulation.
Mr. Amendola said he feels in order to meet the letter of the ordinance, if the property is
sold (again) it would have to be insulated. It vvas formerly a gas station that was built
prior to the current requirements for insulation in our code.
Mr. Diemert said he has no problem with the variance being conditional to require
future property owners to adhere to the requirements of our code.
Mrs. Cinco asked if Council had any questions.
Mr. Ferrante said he has a problem with not going through with our ordinances. He
feels our ordinances should be enforced and is not in favor of granting a variance.
Mrs. Cinco asked how long ago this ordinance was in effect.
Mr. Amendola said approxunately 12 years ago. Very few gas stations were insulated
prior to that time.
Mayor Rinker asked if Mr. Amendola sees any problems with this. He had said
generally he sees no real problem.
