Special Council as <br />Board of Appeals Meeting <br />10/4/93 <br />Page Three _ <br />Mr. Fixler, seconded by Mrs. Leppla, macle a motion to grant a variance to D.O. . <br />Summers, for their b.uilding located at 6535 Wilson Mills Road allowing the applicant to <br />be exempt from the requirement for further insulation on the subject building with the <br />condition that prior to any change in use that it be insulated according to our code. <br />ROLL CALL: AYES: All <br />NAYS: None Motion Carried <br />Variance Granted <br />Mrs. Cinco said there is one more matter Council that requires a variance--for Taffy's. <br />Mr. Diemert introduced Ms. Terri Eloff from Taffy's on Beta Drive, in the audience. He <br />said Taffy's wishes to conduct a sale on October 17 through October 23 (approximately 6 <br />days) at their property. It is not properly zoned for retail sale. As their letter of <br />September 27 explains, this is an activity that would be a one-time deal for clearing their <br />premises of certain goods so they can condense their sale operations and make a success <br />out of their business in other ways. They are going to present this sale to the area of <br />Mayfield Village and the surrounding communities. The liquidation sale would be <br />conducted indoors on their premises. They have more than adequate parking, will hire <br />security from our Police Department during the entire event, and the landlord is in <br />agreement. Mr. Diemert said it is his understanding they have had similar such sales <br />(not for the purpose of closing) which had been approved by the then Mayor without <br />Council involvement. Once this application came in, it went through the Building <br />Department. The Building Inspector determined that it was not a proper use. He <br />presented it to the Mayor. The Administration has no objection to this, but feels it needs <br />to be approved by Council since is in violation to'our code. It would be in the form of a <br />temporary variance just for that one week period. Mr. Diemert asked Ms. Eloff if there <br />is anything she would like to add. <br />Mr. Flynn asked the time frame connected with this. <br />Ms. Eloff said 10 a.m.-7 p.m. <br />Mr. Flynn said he wondered if there would be any problems with traffic. <br />1VIrs. Cinco said they usually don't have traffic problems. <br />
