Regular Council Meeting . <br />September 16, 1996 <br />11 <br />Mr. Diemert said we have had litigation in this town where it was proven to us not to be prudent to <br />deny someone's right to proceed down a path while we are contemplating other ideas. He said you <br />can always exercise your right to change property and eminent domain no matter what stage they are <br />at. The point is you might cut a year off their plaming by letting them have prelinunary approval <br />because it meets our code. <br />Mr. Marquardt, seconded by Mrs. Cinco, made a motion to grant preliminary approval to Goldberg <br />Properties/Sunrise Land Development for the property on S.O.M. Center Road contingent upon the <br />variances being granted. <br />Dr. Parker asked if there is any difference in the prelunuiary approval we gave. <br />Council President Fixler said the initial approval was conceptual. This is contingent on granting <br />variances. <br />Dr. Parker asked if they can still decide not to grant a vaxiance. <br />Council President Fixler said absolutely. <br />Roll Call: AYES: Mr. Buckholtz, Mrs. Cinco, Mr. Fixler, Mr. Marquardt and Dr. Parker <br />NAYS: Mr. Busa Motion Carried <br />Preliminary Approval Granted <br />Sidewalk Maintenance & Grass Maintenance , <br />These items were deleted from the agenda. <br />Motion to authorize an expenditure of $3,410.80 to Howard S. Mack (HMA Sports) for misc. items <br />for the Debbie Hudacko walk and run <br />Mrs. Cinco, seconded by Mr. Marquardt, made a motion to authorize an expenditure of $3,410.80 to <br />Howard S.
