Mayor Rinker <br />said what confuses him is the last time Mr. Frabotta and him were here together--he <br />read Mr. Koren's letter and he made a number of pointed requests as to what if this <br />were to be done were your concerns. Mayor Rinker said he thought that the two <br />primary concerns were if the driveway that there be some appropriate buffering on <br />either side of the driveway and if a building were to be built that there would be an <br />appropriate setback. Mayor Rinker said they also talked about deed restrictions. <br />Mayor Rinker said he had asked again if there was anything else. He thought Mr. <br />Frabotta said that was it. He said what he is hearing tonight is as if we are starting <br />from scratch. We have tried to be responsive to a number of resident's concerns <br />because he knows the idea of a lot split back there has been met with concern. This <br />is an effort to try to allow an individual to get one lot, one access of Beech Hill and <br />trying to put into this certain restrictions on how any development would be <br />performed. Mayor Rinker said we were trying to be responsive--now he feels it has <br />been all for naught. <br />Mr. Frabotta said when he got back and saw that the utility easement for Lot E <br />(which this right-of-way goes over Lot E) and it doesn't make sense. Why should <br />my utility easement be over his driveway and his utility easement be over my <br />driveway? This is all one family now, but say this guy sells off and the neighbors <br />have a problem and something breaks and they have to dig up a driveway, and God <br />forbid there be an emergency back there and no one could get back--if it is my <br />easement, it is my driveway and that is the way it usually is in most cities. Why not <br />tell him that Lot E stays as it is and you can build on Lot D, but Lot D will access from <br />Wilson Mills and Lot E will access from Beech Hill and everybody would be happy. <br />Mayor Rinker said we had received letters from people on Wilson Mills who were <br />not crazy about having yet another access. We were trying to balance the competing <br />interests. Mayor Rinker asked if the problem is that he does not understand the <br />nature of the utility, or are you telling me that you don't like the driveway period <br />and all this other discussion we had didn't mean anything. <br />Mr. Frabotta said no; if you make Lot E access through Beech Hill, you are <br />eliminating E from going through Wilson Mills and now D can go through Wilson <br />Mills. <br />Mayor Rinker said D is already accessed that way. His recollection was that he was <br />trying to shift the separating line. He asked if he was saying that what he had seen at <br />the last meeting is different than what was discussed tonight. <br />Mr. Frabotta said no. At the time, he did not see this easement here.
