Regular Council Meeting
7/17/95
Page 2
wanted his feelings to be known that he did not favor the lot split.) Mayor Rinker
said what confuses him is the last time Mr. Frabotta and him were here together--he
read Mr. Koren's letter and he made a number of pointed requests as to what if this
were to be done were your concerns. Mayor Rinker said he thought that the two
primary concerns were if the driveway that there be some appropriate buffering on
either side of the driveway and if a building were to be built that there would be an
appropriate setback. Mayor Rinker said they also talked about deed restrictions.
Mayor Rinker said he had asked again if there was anything else. He thought Mr.
Frabotta said that was it. He said what he is hearing tonight is as if we are starting
from scratch. We have tried to be responsive to a number of resident's concerns
because he knows the idea of a lot split back there has been met with concern. This
is an effort to try to allow an individual to get one lot, one access of Beech Hill and
trying to put into this certain restrictions on how any development would be
performed. Mayor Rinker said we were trying to be responsive--now he feels it has
been all for naught.
Mr. Frabotta said when he got back and saw that the utility easement for Lot E
(which this right-of-way goes over Lot E) and it doesn't make sense. Why should
my utility easement be over his driveway and his utility easement be over my
driveway? This is all one family now, but say this guy sells off and the neighbors
have a problem and something breaks and they have to dig up a driveway, and God
forbid there be an emergency back there and no one could get back--if it is my
easement, it is my driveway and that is the way it usually is in most cities. Why not
tell him that Lot E stays as it is and you can build on Lot D, but Lot D will access from
Wilson Mills and Lot E will access from Beech Hill and everybody would be happy.
Mayor Rinker said we had received letters from people on Wilson Mills who were
not crazy about having yet another access. We were trying to balance the competing
interests. Mayor Rinker asked if the problem is that he does not understand the
nature of the utility, or are you telling me that you don't like the driveway period
and all this other discussion we had didn't mean anything.
Mr. Frabotta said no; if you make Lot E access through Beech Hill, you are
eliminating E from going through Wilson Mills and now D can go through Wilson
Mills.
Mayor Rinker said D is already accessed that way. His recollection was that he was
trying to shift the separating line. He asked if he was saying that what he had seen at
the last meeting is different than what was discussed tonight.
Mr. Frabotta said no. At the time, he did not see this easement here.
