:t <br />MINUTES OF A SPECIAL MEETING OF COUNCIL <br />Mayfield Village <br />March 9, 1998 <br />The Council of Mayfield Village met in special session on Monday, March 9, 1998, at S:OS p.m <br />in the Mayfield Village Senior Center/Community Room. Council President Mark Fixler <br />presided. ROLL CALL: Present: Mr. $uckholtz, Mr. Busa, Mrs. Cinco, Mr. Fixler, <br />Mr. Marquardt, Mrs. Mills and Dr. Pazker <br />Absent: None <br />Also Present: Mayor Ri.nker, Mr. Brett, Mr. Cappello, Mr. Metzung, <br />and Mrs. Roman <br />Council President Fixler said this meeting is to discuss the Development Agreement between <br />Progressive and Mayfietd Village. There was a question as to whether or not to go into <br />Executive Sessior-he does not think it necessary. <br />Mayor Rinker said he would like to give some background. He thought some information would <br />be included in last week's packet but we did not. About Tuesday or Wednesday of the week <br />before last, Chuck Chokel called him. There is still some confusion between what Mike Uth and <br />Mr. Diemert talked about. Mr. Chokel asked if we could revise three things in the development <br />agreement: <br />1. That the end point for construction of the road be 1998 beginning of 1999 to <br />reflect the roadwork being done strictly within the Golf Course area including White <br />Road. They are going to be building and want to make-sure that when the first 2 <br />buildings open they have ingress and egress. (The agreement was written with 2001.) <br />He thought that was nothing more than a typo. <br />2. Wetlands. The agreement was silent so he saw ambiguity to the extent that there <br />might be mitigation of wetlands for the road running on the Friedman property-that <br />they did not want to be Iooped into that. He agreed he did not think tha.t would be <br />particularly problematic because we never discussed the extent that we might have to <br />deal with any wetland mitigation on the Friedma.n property that Progressive would <br />have to share in it. (He does not think Progressive fully realized its cammitment <br />regazding its agreement to sharing 50-50 the assessment for that portion of the road <br />that runs across Friedman south of their curtent. site.) <br />3. Mr. Chokel said that if we limited the use of the pool to those who only work in <br />Mayfield Village he would run into problems internally with his workforce <br />(particularly with who work on Alpha.) <br />Mayor Rinker said NIr. Chokel had presented these to Mr. Diemert and Mr. Diemert said he had <br />to go to the Mayor. -Ma.yor Rinker said he felt Council needed to address the last one. He does <br />not think it is tha.t critical a point but knows Council is sensitive about that.
