180 <br />Special Council Meeting <br />12/27/88 <br />Page 2 <br />Mr. Rinker said to Mr. Ramos that pursuant to Article 5, Section 4 <br />which states that the Law Director is the principal legal advisor-- <br />don't you feel that you are still within the realm of being able to <br />provide legal advice on this case? <br />Mr. Ramos said that he intends to be active in this. His concern is <br />that he may be called as a witness and he thinks it is important that a <br />specialist is used in the area that is aware of the criminal system as <br />well as the continuity factor which is extremely important. Mr. Ramos <br />said that he will provide Council with any assistance they may reguire <br />in the meantime. <br />Mr. Rinker, seconded by Mr. Santoro, made a motion to adjourn into <br />Executive Session. <br />Roll Call: AYES: All <br />NAYS: None Motion Carried <br />Council recessed into Executive Session at 8:13 p.m. <br />Council reconvened at 8:37 p.m. <br />Mr. Basile asked if there was anymore discussion. <br />Mr. Rinker asked Mr. Ramos what Council should be looking for the legal <br />counsel to do. <br />Mr. Ramos said that Council has two options--that either the Law <br />Director could represent Mayor Carmen or special counsel could be <br />appointed to represent Mayor Carmen in this matter. Mr. Ramos read <br />additional excerpts from the "Legal Representation for Conflict <br />Allegations" letter. He said that the Charter provision specifically <br />provides that the Mayor may appoint special counsel to supplement the <br />services of the Law Director. Such appointment may only be made after <br />the Law Director has certified in writing that he is unable or <br />incapable of representing the municipality and is subject to the <br />confirmation of Council. Mr. Ramos said that he could not receive <br />compensation for any services relating to this matter if special legal <br />counsel was appointed. Mr. Ramos said that he had sent Council <br />certification stating that he would be unable to represent Mayor Carmen <br />in this matter. <br />Mrs. Mills expressed concern about what good the Village's insurance <br />coverage is. <br />Resolution No. 88-65, entitled; "A RESOLUTION AUTHORIZING THE <br />EMPLOYMENT OF THOMAS P. GILL, AS SPECIAL COUNSEL, IN STATE OF OHIO V. <br />FRED N. CARMEN, CUYAHOGA COUNTY COMMON PLEAS COURT, THE AMOUNT NOT TO <br />EXCEED FIVE THOUSAND DOLLARS ($5,000.00) AND DECLARING AN EMERGENCY." <br />Introduced by Members of Council. <br /> <br /> <br /> <br />Mr. Basile, seconded by Mr. Rinker9 made a motion to suspend the rules <br />of Council requiring a resolution to be read on three separate <br />occasions.
