180
Special Council Meeting
12/27/88
Page 2
Mr. Rinker said to Mr. Ramos that pursuant to Article 5, Section 4
which states that the Law Director is the principal legal advisor--
don't you feel that you are still within the realm of being able to
provide legal advice on this case?
Mr. Ramos said that he intends to be active in this. His concern is
that he may be called as a witness and he thinks it is important that a
specialist is used in the area that is aware of the criminal system as
well as the continuity factor which is extremely important. Mr. Ramos
said that he will provide Council with any assistance they may reguire
in the meantime.
Mr. Rinker, seconded by Mr. Santoro, made a motion to adjourn into
Executive Session.
Roll Call: AYES: All
NAYS: None Motion Carried
Council recessed into Executive Session at 8:13 p.m.
Council reconvened at 8:37 p.m.
Mr. Basile asked if there was anymore discussion.
Mr. Rinker asked Mr. Ramos what Council should be looking for the legal
counsel to do.
Mr. Ramos said that Council has two options--that either the Law
Director could represent Mayor Carmen or special counsel could be
appointed to represent Mayor Carmen in this matter. Mr. Ramos read
additional excerpts from the "Legal Representation for Conflict
Allegations" letter. He said that the Charter provision specifically
provides that the Mayor may appoint special counsel to supplement the
services of the Law Director. Such appointment may only be made after
the Law Director has certified in writing that he is unable or
incapable of representing the municipality and is subject to the
confirmation of Council. Mr. Ramos said that he could not receive
compensation for any services relating to this matter if special legal
counsel was appointed. Mr. Ramos said that he had sent Council
certification stating that he would be unable to represent Mayor Carmen
in this matter.
Mrs. Mills expressed concern about what good the Village's insurance
coverage is.
Resolution No. 88-65, entitled; "A RESOLUTION AUTHORIZING THE
EMPLOYMENT OF THOMAS P. GILL, AS SPECIAL COUNSEL, IN STATE OF OHIO V.
FRED N. CARMEN, CUYAHOGA COUNTY COMMON PLEAS COURT, THE AMOUNT NOT TO
EXCEED FIVE THOUSAND DOLLARS ($5,000.00) AND DECLARING AN EMERGENCY."
Introduced by Members of Council.

Mr. Basile, seconded by Mr. Rinker9 made a motion to suspend the rules
of Council requiring a resolution to be read on three separate
occasions.
