169 MINUTES OF A SPECIAL MEETING OF COUNCIL • Mayfie'ld Vi'1'lage • November 24, 1986 The Council of Mayfie'ld Vi'11age met in Specia'1 Session on Monday, November 24, 1986, at 7:37 p.m. in the Council Chambers at the Vi'11age Ha'1'l. Council President Richard C. Etz'ler presided. • Ro1.'1 Ca'1'l: Present: Mr. Basi'le, Mr. Etz'ler, Mr. Flynn, Mr. Go'ley (7:39 p.m. ) and Mr. Petschauer . Absent. : Mayor Carmen Also Present Was . Mr. Feneli Mr. Etzler said this meeting was ca'1'led to discuss Ordinanee No. 86-18 and - that Mr. Fene'li had met with the attorneys and representatives of the Go'lf Course regarding this matter. Mr. Fene:Li said a motion for contempt of Court was fi'led against the Vi'1'lage. Mr. Go'ley arrived at this time (7:39 p.m.) Mr. Feneli exp'lained the procedure that must be fo'1lowed, and the language that must be de'leted in Ordinance No. 86-18. He said the Council cann.ot say they are going to rezone property unti'1 the study has been made. They can hire a'1'1 the people they want to study the area, and when the zov.i:ng experts reports come in, they start the procedure.. Council introduces the ordinance and refers it to the.Pl.anning and Zoning Commission: Then it comes back to Council for them to report a recommendation to Planning and Zoning. Then Council has the Public'Hearing and at that point if someone comes in that can..support a mu'lti-family use of the property.it wi1'1 have to stand constitutional muster at that time. He stressed that Council can't decide what they are going to do before they have the study. Mr. Feneli said they insisted on an order of contempt and the on:Ly way we cou'1'd purge ourse:Lves of contempt was to tota'11.y abandon any activity to rezone that land. He said they a'lso wanted us not to be permitted to hire an expert. They were not able to do that, but we aren't able to have an ordinance saying we're going to rezone land until we have the study from the experts. Mr. Feneli said the Judge set a hearing for tomorrow at 12 noon in the: event Council refused to do this, he wanted a'1'1 of us down there. Mr. Feneli said he amended Ordinance No. 86-18 from an ordinance providing a procedure to rezone certain'property within the: munici.pal.ity to an ordinance providing a procedure to retain the services of a professional p'lanning expert to study the zoning in certain areas. These areas are the same areas that the previous Ordinance No. 86-18 wou:Ld have rezoned. The amended ordinance provides for the Mayor to invite bids from p'lanners- Mr. Fene'li said if
