169 <br />MINUTES OF A SPECIAL MEETING OF COUNCIL • <br />Mayfie'ld Vi'1'lage • <br />November 24, 1986 <br />The Council of Mayfie'ld Vi'11age met in Specia'1 Session on Monday, November <br />24, 1986, at 7:37 p.m. in the Council Chambers at the Vi'11age Ha'1'l. Council <br />President Richard C. Etz'ler presided. • <br />Ro1.'1 Ca'1'l: Present: Mr. Basi'le, Mr. Etz'ler, Mr. Flynn, Mr. Go'ley (7:39 p.m. ) <br />and Mr. Petschauer . Absent. : Mayor Carmen <br /> <br />Also Present Was . Mr. Feneli <br />Mr. Etzler said this meeting was ca'1'led to discuss Ordinanee No. 86-18 and <br />- that Mr. Fene'li had met with the attorneys and representatives of the Go'lf <br />Course regarding this matter. Mr. Fene:Li said a motion for contempt of Court was fi'led against the Vi'1'lage. <br /> <br />Mr. Go'ley arrived at this time (7:39 p.m.) <br />Mr. Feneli exp'lained the procedure that must be fo'1lowed, and the language <br />that must be de'leted in Ordinance No. 86-18. He said the Council cann.ot <br />say they are going to rezone property unti'1 the study has been made. <br />They can hire a'1'1 the people they want to study the area, and when the zov.i:ng <br />experts reports come in, they start the procedure.. Council introduces the <br />ordinance and refers it to the.Pl.anning and Zoning Commission: Then it comes <br />back to Council for them to report a recommendation to Planning and Zoning. <br />Then Council has the Public'Hearing and at that point if someone comes in <br />that can..support a mu'lti-family use of the property.it wi1'1 have to stand <br />constitutional muster at that time. He stressed that Council can't decide <br />what they are going to do before they have the study. <br />Mr. Feneli said they insisted on an order of contempt and the on:Ly way we <br />cou'1'd purge ourse:Lves of contempt was to tota'11.y abandon any activity to rezone <br />that land. He said they a'lso wanted us not to be permitted to hire an expert. <br />They were not able to do that, but we aren't able to have an ordinance saying <br />we're going to rezone land until we have the study from the experts. <br />Mr. Feneli said the Judge set a hearing for tomorrow at 12 noon in the: event <br />Council refused to do this, he wanted a'1'1 of us down there. These areas are the same areas <br />that the previous Ordinance No. 86-18 wou:Ld have rezoned. The amended ordinance <br />provides for the Mayor to invite bids from p'lanners- Mr. Fene'li said if
