60 <br />Special Council Meeting <br />4/2/90 <br />Page 2 <br />Mr. Ramos explained that Council needed to make a motion to amend Ordinance No. 90-17. <br />Originally the variance was said to be for 15 spaces; it is now for 16 spaces. <br />Mr. Rinker, seconded by Mr. Ferrante, made a motion to amend Ordinance No. 90-17 as <br />stated by Mr. Ramos. <br />ROLL CALL: AYES: Mrs. Cinco, Mr. Ferrante, Mr. Flynn, Mrs. Mills, Mr. Pietrafese, <br />Mr. Rinker <br />NAYS: Mr. Basile Motion Cairied <br />Ordinance Amended <br />Mr. Basile said the Planning and Zoning Commission discussed the variance again and turned <br />it down. They said they would like to stick to the ordinance. <br />Mr. Ramos said after lengthy discussions was Mr. Musca he came up with his letter of March <br />30, 1990. It listed the 4 conditions which Council asked for: <br />No office hours after 6 p.m. <br />No more than 3 doctors at this office. <br />The variance will be granted for a period of 2 years. After that time, the <br />variance may be reneweri by Council after they review the parking and traffic <br />study. <br />Musca Investment Company will indemnify the Village regarding any legal <br />action it must take to enforce this variance. <br />Mr. Ramos said he has he has not received the letter of intent from Mr. Musca or the doctors <br />that they will adhere to these conditions. He said, however, on the second page of his letter <br />of March 30, it states that no occupancy permit will be issued by the Building Department until <br />the letter of intent is received. A copy of the executed lease must also be received. He said that <br />if Council passed the legislation this evening, the variance would still be conditioned upon the <br />receipt of the letter of intent. <br />Mr. Musca said that Council has his word that they will receive it. He said the last time he <br />received a variance he gave his word on that and it was done. <br />Mr. Rinker, seconded by Mrs. Mills, made a motion to suspend the rules of Council requiring <br />an ordinance to be read on three separate occasions. <br />Roll Call: AYES: Mrs. Cinco, Mr. Fenante, Mrs. Mills, Mr. Pietrafese, Mr. Rinker <br />NAYS: Mr. Basile, Mr. Flynn <br />Motion Carried <br />Rules Suspended <br />Mr. Rinker, seconded by Mr. Pietrafese, made a motion to enact Ordinance No. 90-17. <br /> <br /> <br />
