163 <br />MINUTES OF A SPECIAL MEETING OF COUNCIL <br />Mayfield Village <br />October 5, 1992 <br />The Council of Mayfield Village met in Special Session on Monday, October 5, 1992, at 8:07 p.m. <br />in the Council Chambers at the Village Hall. Council President Bruce Rinker presided. <br />ROLL CALL <br />Present: Mr. Basile, Mr. Busa, Mrs. Cinco, Mr. Ferrante, Mr. Fixler, Mr. Flynn, <br />and Mr. Rinker <br />Absent: None <br />Also Present: Mayor Pietrafese, Mr. Amendola, Mr. Diemert, Mr. Hovancsek, Chief Mohr, <br />Chief Stevens, Mr. Toth, and Miss Heath <br />Mr. Rinker said one of the items this Special Meeting was called for, was to consider the variance <br />for the Don Ray building. He asked Mr. Diemert to review a couple of points and to indicate <br />where matters stand with Planning & Zoning. <br />Mr. Diemert said at the last meeting of Council it was his understanding that Council's sentiment <br />was inclined toward granring a one-year variance with certain terms and conditions and that he was <br />to write a letter to 1VIr. Panzica expressing those terms. He did that by letter of September 28. Mr. <br />Diemert said he heard back from Mr. Panzica that one year was not acceptable with the tenant; they <br />need three years to make it worthwhile for them to enter into a lease and move onto the property. <br />Mr. Diemert reported that tonight the Planning and Zoning Commission read his letter and <br />reconsidered the situation and voted, for the most part, against recommending any variance for that <br />property. Also, they felt Council was contradicting the rezoning of that azea. <br />Mr. Rinker asked Mr. Panzica to briefly state his position. _ <br />Mr. Nacy Panzica (in the audience) said he was sorry to cause a commotion. He had other people <br />calling on the building but he did not want to cut it up. He thought one user, who would be low <br />key using it for five years would be best. The last Law Director sent him a letter stating that he <br />could use it for the intended use. Warehouse, yes, Mr. Panzica said it is a warehouse; but they <br />will have about 14 people in there repairing furniture. He does not know how many trucks Don <br />Ray had going in there with trailers. Mr. Panzica said he felt a few furniture irucks going iri and <br />out would not cause any problems. Regarding a year to year lease; he does not want that. He was <br />going to ask for a five-yeaz variance. <br />Mr. Rinker asked if Mr. Panzica was given a formal opinion from the Law Director. <br />Mr. Panzica said he has a letter. <br />Mr. Rinker said if Mr. Panzica was given a formal opinion from the Law Director Council <br />definitely needs to see that letter. <br />
