~~~ <br />~:: <br />~~ <br />MINUTES OF A PUBLIC HEARING <br />Mayfield Village <br />March 17, 1980 <br />The Council of the Village of Mayfield met in Special Session on <br />Monday, March 17, 1980 at 7:50 P.M. in the Village Ha11. Presi- <br />dent Alan Bennett presided. <br />Present: Messrs., Bennett, Flynn, Spellman, Mrs. Hanus and Miss Trask <br />Absent Messrs., Boger and Carmen <br />Also Present: Mayor Beebe, Gus Amendola, Dale Feneli, Steve Hovancsek <br />Mr. Feneli stated the.Public Hearing was being held pursuant to notices <br />being sent in compliance to the Charter requirements for the request for <br />rezoning of the Edward J. DeBartolo Corporation. The property is loca- <br />ted at the N.W. corner of the Mt. Vernon Industrial Park, the street <br />address being 6649 Wilson Mills Road: .The requested change is from <br />Small Office Building District to a Motorist Service District. <br />Proponents: <br />Mr. Dean Hoover, Attorney and David Handle of the DeBartolo Corporation <br />were present and clarified for Council there desire~to have the proper- <br />ty rezoned, Mr. Hoover explained that because of Council's concern that <br />a service station, car wash etc. might go in, they have agreed to file <br />a restricted deed which will assure them that a business of this type <br />would not go in. The only type of business that is feasible is a sit <br />down type restaurant. Because of the estimated six months rezoning pro- <br />cedure for this property, they are not able to get a committment from <br />anyone. <br />Mr. Davis stated that two. problems exist (1) the restrictive nature <br />of the small office zoning and the long, rezoning procedure. <br />Mayor Beebe questioned what uses do they have in their plans. <br />Mr. Handle stated that a few restaurants and banks have .approached <br />them but no committments have been made. <br />Opponents: <br />Mr. Julius Paris stated that he is the owner of a $4,000,000.00 Office <br />Complex presently being built in the same vicinity and faced the same <br />problems of the DeBartolo Corporation. When Mr. DeBartolo purchased <br />the property, the title was not transferred until six months after the <br />rezoning went into effect. He definitely does not want a Burger King, <br />'.:Donald's or the like to be across from his fine office building. <br />wr.a,t they need is an added classification which would allow a business <br />that~is compatible with the adjacent uses on the park.
