1VlIlWTES OF A REGULAR M3EETING OF COUNCIL <br />Mayfield Village <br />August 11, 1997 <br />'I'he Council of Mayfield Viliage met in rEgular session on Monday, August 11, 1997, at 8:30 p.m. <br />in the Mayfield Village Senior Center/Comumunity Room Cauncii President Mazk Fixler <br />presided. <br />ROLL CALL: Present: Ivir. Buckholtz, Mx. Busa, Nlrs. Cinco, Mr: Ferrante, IW. FWer, <br />Mr. Marquardt and Dr. Parker <br />Absexit: None <br />ALso Present: Niayor Rinker, Mr. Brett,ll+Ir. Hancnlak, Mr. Havancsek, <br />Mr. Metzung, Chief Mohr, Mr. Saxnac and Miss Heath <br />OPEN PORTION <br />Mr. James Dindia Hickorv HR1 Drive, said his neighbors have 8lights shining in his bedraom <br />window. He has talked to May+or Rinker, Councilman Marquarclt and Mt. Ivletzung. They can't <br />sleep and no one is helping them. in the beginni;ig they were told the Valtage would help them- <br />but nothing is being done. If we can't do anythittg for them, they will go to the Lyndhurst Court. <br />They have talked to tiifferent attorneys about the nuisance (having 8-9 lights shining inta their <br />home.) Mr. Dindia said that is not nice of them. He said it is hard to sleep with lights shining in <br />our bedmom windows. He asked for the Village's help. If we can't assist them, he pians to put up a high fence. <br />Cowneeil President Fixler said there is no one on this body who would not want to help them If <br />your neighbor is not breaking any Viliage laws, the Village has very little control about what one <br />does in a househald. Hovvever, af you want to put up an 8' fence-if the fence is in violation of <br />1Vlayfield Village law, we can't allow you to put up a fence iugher than our code permits_ <br />Mayor Rinker said Mr. Dindia's neighbors have added sliieldzng to the }ights as-well as reducing <br />the wattage in all of #hem. VVe have looiced at aur ordinances but tiiere is nothing in our <br />orduianee that empowers us to imtervene more_ than we have done. We ha-ve tried to take the <br />pasition of promoting good neighbc3rs as much as passble. They have a right to illumuaation. H-e <br />understands the Dindias use shades-and does not knaw why they aze not effeetive but there is a <br />point beyond which we can't require people to clrange. If you wish to follow civit litigation, you <br />are entitled to file alawsui# but he thinks any lawyer worth lus salt will tetl you are going to pay <br />money far prabably a doubtfiil result. We have tried to address it in what we feel is a friendly <br />way. He does not think the Villa.ge can do any more. <br />, <br />Mr. Dindia asked why the Village can't make them iurn the lights offat 11 p.m. or 12:00 am <br />Mayor R.inker said we can't tell them to do that.
